    This is NOT true.
    If she wants to apply for the spousal visa but not AOS which will result in a CR1 visa - it will be via a USCIS Service Center not through the consulate - and there is no reason that the process cannot be started while she is in the US. Follow the guide above for the CR1 process.
    Just make sure she leaves the US and goes back to her own country before the end of her tourist visa. And if she has a valid tourist visa or VWP she can continue to visit during the whole process as many of us have done.

    Oh, if you can bring the following to the interview it may help if the subject arises of your visit to the US with the intent to marry. As you said, your boyfriend proposed to you on xx/xx/xxx and your family rushed to coming to the wedding - you can provide them with information on when the tickets were booked which should be dates after the proposal and it should be also closer to the wedding date. If the wedding was planned a long time ago, then the tickets will show several months when they were purchased.

    I think the above poster is using unnecessary scare tactics and you have little reason to worry. You have a well established relationship. You have proof that you intended to return home to Germany after the visit. He has lived and worked in Germany and you have been dating for a number of years in Germany. He now lives in the US and on a visit to him, you decided you didn't want to have to spend more time going back and forth, that you wanted to live together as husband and wife. You were not engaged when you entered. You became engaged 2 weeks after your arrival. You planned a wedding for 2 months later at which both of your families attended. You are from a country that is a low risk for immigration fraud. The difference in your ages is not that great and will become 'less' as you both get older. There really are no real red flags on your situation from what you have said.
    There is no rule that states marriages that happen less than 90 days after arrival in the US are fraud. If you had entered the US and got married 2 weeks later then you might have to address the issue of intent upon entry but that did not happen. Your time line is very real and very believable. DO NOT ABANDON YOUR AOS application. There is no reason to expect you will have difficulties in adjusting status. Bring to the interview proof of your intent to return to Germany after this visit, ie, having to tie up your affairs from a distance (ending employment, breaking lease, selling belongings, etc.). Have your parents and your in-laws write affidavits of their knowledge of when you became engaged and decided to remain in the US. Bring lots of evidence of how you have joined your lives together in a valid relationship after your arrival in the US. I have every confidence that you will be perfectly fine.

    Hi and welcome,
    As Huggles mentioned, it's a good idea to read the guide first.
    You need to start with forms I-130 and G-325A, which you will read about. These you will send to USCIS to start the CR1 process. You might want to download the forms and have them all filled out to send in now or when your Husband gets back to the U.S.
    You cannot apply at the consulate in Calgary, to do that both parties must live in Canada. You will ultimately interview in Montreal.
    The interview is basically so that they can look at you, ask you a few questions - nothing too awful, just an awfully long trip to Montreal
    You will also need to have a medical, done by a panel physician in Canada. There are 4, one in Vancouver, 1 in Montreal and 2 in Toronto.
    Anyway, once you have read the guides you will have questions and we are here to help!

    Very good advice!
    When the Canadian officer asks the purpose of your trip, I recommend you tell them exactly what you are doing, when you are planning on returning to the US and that your intentions are for your new spouse to immigrate to the US. Be prepared as in any visit to show your ties to the US, ie, job and residence in the US that you are returning to. Travel with only the necessary personal belongs for your length of stay and have adequate money or available funds to support your intended length of stay in Canada.

    Well - you can certainly try for the emergency issue for the AP - however, your reason may not be good enough for this - they may tell you to wait for the AP you sent with your AOS to process.
    Did you apply for the EAD/AP with your AOS application?
    If you cannot do your biometrics before you go, you would have to re-schedule it, if you don't - your out of luck. I would suggest you wait till the greencard is in hand before doing anything extended like leaving for 5 months.
    At your infopass - you can ask for more information on the bio's.
    When you travel, the plane tickets need to in the name on your travel documents, in this case, the passport and the AP. What name will be on the AP? If they are different, you may have issues.
    The recommendation is to change the passport to the current legal name she is using, to avoid issues.

    When I renewed my passport I used the Simplified Renewal form, but they still wanted to see documentation from me- If I remember correctly they just asked to see prof of citizenship (my birth certificate) and a photo ID (my Ontario DL) and then returned them to me immediately. I asked for the old passport back and they returned it to me on the spot after cutting off the one corner to invalidate it.
    If you'll be in Canada for a week I think that should be enough time. Just tell them when you're applying that you absolutely need your passport within the week because you'll be returning to the US. When I renewed they asked me specifically if I needed my passport within a certain time frame for travel, so they are aware of the different circumstances that might dictate a little bit of an emergency.

    I view it as 'abnormal stress' - and IMO, should be treated as such.
    Can't suggest what to do for the husband, but for you , during the next three weeks -
    cut contact with him by half and
    spend your free time doing
    yoga and
    aerobic exercise (ya, even speed walking is useful) and
    meditation and
    get back to that hobby that you've neglected for so long.
    The first three get yer body to shift a bit, and a shift of body chemistry without prescriptions is always good.
    Seriously - you need to get back to being Human.
    You were Human once - remember how it was?
    Get back to it - and note - it ain't easy getting back in the groove -
    you've allowed this @#$@% Visa Process to permeate your being and yer marriage.
    And It Shows.
    No, I'm not knocking you, not at all.
    Been There, Done That, Wrote the Screen Play, and Sold It .
    It's nerve wracking, ya don't sleep, arguments over nothing instantly nosedive into repetitive topics of
    'You Don't Love Me' or
    'I'm giving Up' or
    'Why didn't you do the paperwork __THIS__ way, to begin with?'
    You need to relax yerself.
    For an immediate jumpstart, for you - get out to a Day Spa on Sunday
    and have a deep tissue massage along with a mani/pedi.
    You'll feel better, trust me.
    If, after 3 weeks of the yoga/aerobic exercise/meditation routine, that stress is still there - strongly suggest you get into a therapist's office and unload all with him/her.

    While our wait was no where near what yours has been, while we were waiting for our I-129f approval the processing time dates kept being pushed back further and further so that the original 100 days that was stated when we filed, became 120 and then 180 - and as we approached and eventually passed the 180th day with no decision, we started having problems. All of our attempts to find out any information - including a visit to his Congressman's office - produced zilch, and we felt like we had been abandoned in the Black Hole of Calcutta. My fiance began to feel that maybe this was a 'sign' that we were not really meant to be together. We started having arguments and disagreements - and as you so well describe it - there was an elephant in the room. He started having second thoughts - and third - and fourth . . .
    He was up visiting over Christmas and friends were giving us an engagement party on the night after one of these frustrated discussions. We went and I didn't even know if we were still 'engaged' or not. We smiled and put up the pretense of 'the front' while all the time we were mulling over whether we were going to continue or just abandon everything because it was going no where. The very next day the NOA2 came through - but it was bittersweet because the elephant was still there. I didn't feel any joy or relief - just the sense of not knowing what was going to happen because even though the NOA2 had finally come through, I didn't know if 'we' were going to make it.
    He returned home without us having any discussion about the NOA2, and without making a conscious decision one way or another. When I got my package from Montreal I finally asked him if I should continue, and he said 'yes'. We've had a few rough times since but that was definitely the hardest of them all and the one that nearly broke us up. I still tremble to think what might have been - or in this case - not have been.
    So, my suggestion is not to make any sort of a decision now while you still have this big unknown in front of you. What you are feeling now will change once that USCIS barrier is gone. Then, when you are not dealing with the stress caused by the 'cone of silence' forced upon you by the Consulate, you will be able to think more clearly about what you two really want. However much longer this process takes, that same amount of time is going to pass no matter what you do. Why not continue to 'wait it out' together? Try not to use the 'wait' as a reason for making a decision about the relationship. Wait until you have a decision - and then decide if this is what you still want now you have that barrier removed.
    You are near the end of the process - see if you can wait until there is something more definite before you make a decision that you might regret. Good luck to the two of you, and I hope you hear good news soon.

However, this thread is not asking for your judgements on an individual's case which you know nothing about. It is asking if anyone is interested in taking legal action. Please refrain from personal attacks and derogatory comments or administrative action will be taken.

    Can we add a couple of new forums onto the site, please? I know the K-1 forum got a sub-forum for all their approval and progress threads, so maybe we can add a few sub-forums onto the Off Topic Forum? They can be called:
    American Politics Forum
    Anti Illegal Immigration Forum
    Sex Talk Forum
    You could possibly combine the American Politics and Anti Illegal Immigration forums into one, since they usually become intertwined and indistinguishable. That way we don't have to sift through tens of pages of the above to get to the more interesting stuff, which is getting lost amongst the clutter.

    Ms. Dawn, maybe you should consult with a lawyer who would weigh the particular evidence in your case that shows your initial intent to return to HK when you entered the US on a tourist visa (such as hubby adjusting to a resident there, still paying rent or having property there, still having a job there, etc.) against the possibility of denial for supposedly misrepresenting your non-immigrant intent.
    I think a lawyer would be better able to judge how convincing it appears that you were intending to live permanently in HK but suddenly changed your mind when you came here than a forum full of people who know only that you got married before you came to the States. Still, what the others have pointed out is a real possibility, so act carefully.

    I would definitely call and ask - I believe that you have up to 3 months (please check this though) to activate your visa. A lot of people have to pack up their place, quit their job, move, etc., so it gives them a little bit more time. I don't think in those situations though they're crossing the border.

    If you want to marry someone that is a liar and has a ban because of previous lying and fraud he would have to request a waiver. If the waiver is granted he can then come here and promise to love, honor and cherish you the rest of his life.
    The experienced people at DHS tend to take a dim view of such promises from people that have demostrated clear contempt for laws, rules, promises etc.
