    It seems your name was inputted wrong for the i485. You should have corrected this when you got the NOA2, it has a note on it to check that the information is correct and if not to notify them. I had to do this as well but called the day after I got it so it never became a problem later on. That's water under the bridge now though, you can't do anything about missing that part
    If I were you I would start the i90 right away - since it will need to be filled out regardless... 
     
    (IF they are able to help you in any other way,  that's just a bonus but you won't have lost any time in case they aren't... )

    With that note I've seen people done it either way and been fine.

    Your only requirement for K1 is to be married within 90 days after arrival. It's best to file for AOS soon after marriage but some people have waited months or even a year after marriage. However, you will not be able to work or travel outside and return to the US until you have EAD, AP or AOS approved.

    Check with your local county court, some licenses have a 72 hour wait time. They gave us ours the day we applied, but it was only because we were getting married past that 3 day wait time.


    You're considered out of status once your I-94 expires. 90 days starts ticking the day you enter the country, so when your I-94 expires, if you haven't applied for AOS and recieved the NOA1 (form I-797) then you're out of status.

    No harm though if you don't apply for AOS until after your I-94 expires, just do it as soon as possible.

    Once your have your NOA1 for AOS you're in a limbo status, you're legal enough to be here, but not legal enough to do anything. It usually only takes a week or two to get the NOA1 paper.


    And as for the marriage cert, again, like with the license wait time, find out if you can take the signed license after your wedding to the court house yourself to turn in. If you can then you usually can get a copy of your marriage license and have it in the system the same day you give it to the court records office.

    My list said that I needed medical records for any surgeries done. I've been in and out of the hospital and have had surgeries, so I needed to get those and get my doctor to sign notes for some prescriptions (like the anxiety medicine, also migraine medicine). If you haven't had any surgeries done and don't take any prescriptions, you should be fine.

    In general, a married couple who file taxes together would both need to be cosponsors.

    Well the guidelines say they have 5 months to process your application and so you are still in that window. As far as the lawyer is concerned, I'd take him out back and let see the stars if you know what I mean. I hate scamming lawyers.

    @SnowCone: I think so too, I got my first notice by email at exactly midnight here. So clearly scheduled to send out any queued up notifications at once each day (or at least something similar.)

    If you guys are interested this is how my notes are looking now concerning the pending NOA2's on this website:
    Date VJ December January February March
    1-Mar 13-Jan 67 164 166 x
    8-Mar 18-Jan 60 137 195 31
    15-Mar 25-Jan 52 128 218 66

    The estimation for this week was that the NOA1's with the date 23. Jan should be in processing BUT the date that VJ shows is 25. Jan so there is some nice progress.

    So as you can see we seem to be moving a bit faster but the February number has gone up rather than down. I think in the next two weeks the February number will go down.

    So according to my oh so scientific estimations next week (22. March) the NOA1 with the date of 1st of February should be processed.

    And now I should go back to studying!

    Here are my questions:



    1. Is there a particular font and size that USCIS prefers for the cover letter, fiancé(e) letters of intent, and I-129F supplement?

    Don't think so, I just used default 11pt font... Arial or something similar and easy to read.



    2. My passport can be used to show two things: my US citizenship and my ongoing travels to my fiancé's home country since 2008. Should I print two copies and place them in each section, or will the reviewing officer refer back to it on his/her own as needed? Since my passport alone does not validate my citizenship (it's only valid for 4 more years) should I move the passport images it entirely to the "Proof of having met in the past two years" section, and leave my birth certificate to prove citizenship?

    - We just put in both passports and then USC birth certificate to show citizenship... Not sure, but I think either would work.



    3. I read that staples are a no-no, are paper clips fine to keep each section together?

    - Read this two and we used the two hole punch and the prong fastener (I think that is what they are called...) it's in the visa guide.



    4. One Visa Journey member placed post-it notes on the first page of each section as a guide for the officer - is this a good idea?

    - I did this. Honestly, was a pain in the butt, but figured best to be organized. Up to you. I would include a table of contents of some sort in the cover letter.



    5. I get this idea of "front-loading" the officer with information, but have I included too much evidence?

    - Really similar to what we included. We were approved. Some countries look for this and others don't. Ours doesn't, but again we had it so figured we might as well send.



    G325A - Send one for each petitioner and beneficiary.



    You look like you are pretty much set. You can double check instructions to be sure, but your package sounds very similar to mine and others that I have seen listed on here.



    Oh, one thing I don't see is passport/Visa style photos. You will need those with the G325A for both of you.

    Careful to have the DKTP (the K is very important), not only DTP.... I had the same and had to do it twice... and it hurts like a mother for a few days
    You will also need BRM. See if your GP can do this for you.
    She was not rude when I was there, she was just careless with writing on the paperwork... so be careful and read what she writes on those forms
    Ah... and don't forget to bring 4 pasfotos, not just 2.

    Yes, you have enough proof.
    And yes, you both need to sign a letter of intent. You can find examples of this letter in the guides. The letter basically states that you are legally free and willing to marry within 90 days of entry into the US using the K1 visa.
    You can file for an SSN about two weeks after entering the US.
    Once you get married, you can file for AOS/EAD(work permit)/AP(travel permit) ... do these all at the same time, so that the EAD/AP fees are waived. The fee for AOS is $1070.
    You do not need to have a SSN to file for AOS/EAD/AP. You will, however, need one to work.

    I wouldn't imagine it to be a problem, but make sure you take all the documentation with you to prove it. All the forms ask if you have ever been known by any other names, so if the answer is yes, whether by former marriage or otherwise, they will want proof of this. I don't know what your embassy's position is on translations though. If everything else needs to be translated, I would imagine the name change papers would be, too.

    Then I suppose it would be answered as just what you stated here. Unemployed due to traveling and plans to move to the US to marry my fiance(e)? There is no requirement for the foreign fiance(e) to be employed, so just answer honestly, as with everything, always.
