It has lots of variance, do you have any asset and number of member in your family? SSA will require you to submit you bank statement, doctor statement, etc...

Like others stated how the heck does you being on disability and her going to her home country for her family members graduation relate? As long as she has her AP or green card she can go back for the graduation . Assuming that’s the only reason -she’ll be back in the USA w no issues. Now if she’s going for 6+ months (clearly NOT for the purpose of going to a graduation) she can have trouble.
if you are collecting disability from work one would be inclined to believe you have health insurance through work, no? Doctor visits due to this disability should be covered/submitted. If your income level dropped so much from disability v regular take home pay and you meet the financial requirements for food stamps than yeah apply. Wouldn’t it make most sense for her to take care of you?! So many people try to be together because one is ill...

Well yes. After she has the green card, she can leave for short trips. Generally under 6 months is no problem.
What does that have anything with you having file for disability?
-
PolarBearCBB reacted to samuelam in K1 - Permanent Residence - Disability
Only for short period of time. Else it consider abandon lawful permanent resident (LPR)

Why would she leave once she got her green card? Does she have EAD(work permit)? Have her just start working. You receiving disability for yourself shouldn't have any effect on her status. She could be working and helping you out.
Now, yes, she could temporarily return home if that is what you both want, but remember she can't stay out of country for too long without a re-entry permit.

Deportation doesn't work like that and it does not happen for those reasons.

Where are you in the process, have you been interviewed?
-
PolarBearCBB reacted to samuelam in K1 - Permanent Residence - Disability
Go to SSA and your state Department of Human Services to apply for your benefit.
Also, you could go to ssa.gov to get your monthly estimated disability benefits and apply online.

PolarBearCBB reacted to geowrian in HELP - Adjustment of Status I-485 Problem
Sorry to hear about the accident and medical problems.
A few items:
It sounds like you already filed for AOS. If so, the existing I-864 you filed or AOS is still valid. That said, if the IO requests a new I-864 then you will need to provide an updated one. If they learn of the change in work status, they are likely to do so IMO. The I-864 income level is based on your current income level. If you are not currently earning money, then that income is $0. Do you have any sort of disability income? That can be counted. Tax returns for an employee only show past income, not current income. For instance, if I worked 6 months last year @ $100k/year then got laid off, my current annual income is $0 ( not the $50k I earned previously). If I was unemployed for the first 6 months then got a job making $50k/year, my current annual income is $50k. The IO makes a public charge consideration based on the totality of the circumstances. So the tax returns / work history may be a consideration for that as well. But a satisfactory I-864 (meaning meets the minimum current income or suitable assets) must be provided. I'm assuming your wife has an EAD. If so, her income can be counted on the I-864 (no I-864A needed for your spouse as the intending immigrant being sponsored). I'd recommend having a new I-864 (plus supporting documentation) ready to present for the interview. Don't bring it up unless asked. That way you're prepared in case they do ask for one.
Worst case is they issue an RFE requesting a satisfactory I-864...either if you start earning income again before that is due, or via a joint sponsor.
Best wishes and I hope you have as speedy of a recovery as possible.

PolarBearCBB reacted to Ash.1101 in K1 Visa Denied (Questions and Advice)
Normally for K1, you have the time to send financial info that's a month old to three months old, so for the most part, pretty recent info.
If the consulate doesn't take cosponsors, then they will just immediately deny, your financial situation normally doesn't change THAT much between the time you gave them info at the interview, which is usually dated recently, and shortly after the interview. In this case, his situation didn't change, he simply didn't have enough proof of income for them to consider it. With a tax return last year of 4k, and three months worth of paystub and an employer letter, the best thing he could have added was a bank statement showing monthly deposits for the last six months to back up he is in fact getting X amount of money per month. Some consulates will also just look at the tax returns and take them at face value.
If it's a consulate that takes cosponsors, they will do a 221g with consideration and mark a new I-134 from a cosponsor as what they want to complete the process.
I do agree tho on finding out if there's ANYTHING else that may have hurt you.

You can withdraw and start a new one right away, but as mentioned, unless you do something about the red flags, you may well get denied, especially as you are effectively adding another red flag (not having seen eachother for almost 2 years, which is considered unusual for a bonafide couple).
Personallly, in your shoes I'd meet once more before filing again, perhaps have a small engagement ceremony and take pictures to show.

PolarBearCBB reacted to f f in K1 Visa Denied (Questions and Advice)
there is no point starting a new one until you can address the reason why this one was denied or else you will just be rushing off to another denial.

PolarBearCBB reacted to Penguin_ie in K1 Visa Denied (Questions and Advice)
You make enough money, what did you show to prove that?
What do you mean you are not engaged? You must be engaged and ready to marry for the K1.
-
PolarBearCBB reacted to Ash.1101 in K1 Visa Denied (Questions and Advice)
Do you mean you aren't formally engaged like a ring and a proposal?
You need to be engaged in the ways that even if you have no ring, that you plan on marrying her within 90 days of her coming into the country, also known as, being engaged. If she said ya'll weren't engaged that right there would deny you, or she called you her boyfriend too much. You had to send a intent to marry letter, that is literally you saying you are engaged to marry this person.
What proof of income did you have? Did you include say 4-6 paystubs for this year, employer letter detailing if it's a permanent position, temp position, and how much you have earned and/or projected to earn for the year? Could even provide bank statements showing deposits per month.
If you sent plenty of proof showing that you CURRENTLY make enough, it could be multiple things that got her denied, but they only need to have one reason. Her saying she's your girlfriend and you're her boyfriend and NOT fiance, and you having a DV charge could make them deny on basis of, well you don't get a K1 visa if you're not engaged, and they could have denied based on welfare of your girlfriend. They don't need to list ALL the reasons for denial, they really only need one.

Gross income. In my case, my salary.
-
PolarBearCBB reacted to Cali_D in I - 134 Form (Annual income)
Gross income. Before taxes and all deductions. I am 100% sure of this.
-
PolarBearCBB reacted to KayDeeCee in I - 134 Form (Annual income)
Gross income, before taxes.
If you are an employee, then you list your current annual income, not what you made last year on your taxes, and provide letter from employer and/or recent pay stubs to show that amount.
If you are self-employed, then it will be your Total Income, line 22 of the 1040. This is gross income, but after business expenses are deducted.

PolarBearCBB reacted to Anh map in K-1 Visa, and Sponsors (merged)
Read the sponsor's contract at the end of the I-864.
Also, the I-864 has been used in some instances for the beneficiary to sue the sponsor to make up the difference between their income and the poverty level.
Divorce does not end the sponsorship obligation.
Do a Google search for more specifics.

Comission CAN count, if it is steady and reasonably reliable; it is one of these things where having a year's worth of paystubs with the comission being at a similar level all the time helps.

PolarBearCBB reacted to Anna Grant in PRENUPTIAL AGREEMENT
It is not at all unusual for an American to ask for a pre-nup. Especially if this is not going to be their first marriage. They want to protect themselsves and often their children from a previous marriage. He may be 100% confident in you but he may also want to demonstrate to other people that you're not in it for the money.
I am the benficiary and I offered up-front to sign a pre-nup to protect my husband to be, He has two grown up children - i have no children and I am too old to consider having children now. His lawyer suggested to him that if he married again, he should insist on a pre-nup (that's from his experience helping my fiance through his last divorce).
However, even after all that, my fiance refuses to consider a pre-nup. We have discussed how we will devise our wills after we are married as I have no relatives but that is as far as it goes.
