Surely the best option is to wait until the son has moved, then there is no confusion as to why they want to visit, and in the mean time make a couple of trips to other countries.

How long exactly did you spend on previous visits and how long did you leave between them?
Off course he told you to apply for a B2 visa, he can tell you whatever he wants. Saying its better suited to you and that it will be easy to get was his way of keeping you calm and not make a fuss about anything. He lied to you and is allowed to.
No point calling the embassy. Only way to find out is to apply. Your chances are very low.

Is the approval chances all completely dependent on her ability to demonstrate ties to her country, and nothing else?
Yes.
Let us know the outcome.

She has never had a passport? So never travelled abroad? And lastly I was not aware that she had to get a passport first (as I said I am green).
What is the process for the passport?
Thanks
Tell her to save her money, highly unlikely to get approved.

After all being married..should have an impact on the situation and also proof of application for residency .....which BTW cost $7000.... for myself..here in Australia...should show ample justification that we do not intend to migrate....at the same time as a spouse married to an american citizen...I could apply for residency for him.....I am not interested in residency in the US...just a visit......
No not really.
Why would the US care about what you are planning to do in Aus? They dont. All they want is for people to leave the US when they are supposed to. I am not sure how you 'accidently' overstay. Not hard to calculate what day you need to leave.
Don't expect much apart from another denial.
-
Not sure why you think your marital status is relevant..she needs to show strong ties to return to her home country if she wants to be approved.

Thanks for the info...very odd post.

OP you sound very very very (did I mention very?) desperate to get into the USA.
You even stated that life would be a lot better for you over there. And that you see potential for employment. And you entered the lottery.
All these things are reasons to deny you entry. You were rightly denied the first time as I am sure the CO could see all these things.
You are applying for a tourist visa...ie. to visit as a tourist. If you can't go then move on and find another country to visit. The fact you even made this topic shows that you did not plan to just visit as a tourist.

I am not sure what advice you are looking for?
You made a mistake, and a very big one in US immigration terms, and you have to deal with the consequences.
You were applying for a US tourist visa. I do not believe at some point you did not even remember that someone had filed a petition for a US visa for you previously.
Off course you can reapply, but don't expect a different result. Start looking at other places to celebrate your birthday.
-
Why would it be a problem?
Tell them the truth, as always.
-
You just proved exactly why there is a stereotype and rightly so.Indeed. The minimum tourist visa fee of $160 per application may only be 0.6% of Welsh per capita GDP but it's 6% of Nigeria's. And the application hassle is a lot more: it's a day's commitment if you live near one of the two cities with a US consulate/embassy and more if you have to travel. Not to speak of missed career opportunities (conference attendance, business meetings, etc).
All countries in the world are not equal, as you clearly stated, so you can not and should not treat them all equally, just looking at the applicant, not taking into consideration their home country.

You already overstayed by choice, why would they believe you this time?
Simple answer is they dont have to.
-
You sending documents is a waste of time as it is their own ties to Colombia that matter. There is no 'sponsorship' and you paying for everything is another red flag, shows the applicants cannot support themselves so have more reason to not come back.
Do not buy a ticket until the passport with the visa is in their hand.
Let us know the result.

No and no.
Even if you bring them they probably won't look at them, the answers to their questions and how you answer them are more valuable than the paper you bring.
-
Are you trying to say that a B2 visa guarantees entry into the US? Because that is wrong."A visa is a conditional authorization granted by a country to enter and temporarily remain within, or to leave that country."
It would be easier if some member/s just answer the questions asked and be useful in providing information requested.
And this is a public forum if people want to reply to a specific (incorrect) part of what someone has posted to correct them instead of just answering their question then they can do that.
-
I am not sure what kind of advice you are looking for on here?
You have a previous B2 denial, ESTA denials, previous 'history' in the USA, you can't honestly think getting a B2 now will be a walk in the park?
Only way to find out is by applying and going to the interview.
Also did you apply for a B2 the first time while you were eligible for VWP? That was a big mistake..

What makes you think anybody, especially the CO, cares about why you want to to go the USA and how it will make your life easier/better?I had an observership offer in clinical psychiatry from a hospital in Chicago. They provided me with an invitation letter. I even had visa assisting letter from ECFMG for my exam.
On the contrary, I had an assumption that it is very unlikely for a doctor to get a usa tourist visa easily. I already knew that it will be difficult for me to get visa. Doctors have to face hard time to get visa for step 2 cs.
I really wonder if there is any immigrant doctor in this forum who can really help me out.

Before she travelled to the US, was her intent to marry you and stay once she was here?Hello I am a U.S. citizen. My girl friend from china has just come to the USA on a travel visa. Can I marry her so she can stay in the USA with me?
-
Sounds like you were correctly denied.
All the ties to your home country cant be strong if you are going to abandon them all to move to Canada.

Thank you so much for your reply. My parents both work for government jobs and they are showing one month leave from their office, to attend my convocation. And they are showing their bank accounts but they dont have much money on the account, so my brother(same parents) giving his bank statement and letters that he will give them financial support for flight and others things. Is that will work?
No.
Your brother has nothing to do with their application. They apply by themselves and have to satisfy the CO that they will return to their home country.

The date on the online i94 is correct.
The date that is stamped in passport can be wrong due to human error. Happened to me on a previous visit.
Visa for business/visit girlfriend
in Tourist Visas
Posted
No it will not effect your K1 app.
What country are you actually from?
I am confused why you are going to apply for a work conference when...there is currently no work conference planned. Sounds like you want to apply saying its for work thinking its a higher chance of approval, when really you want to visit your girlfriend.
You are over complicating things. You apply for a B1/B2 visa which allows you to enter for business (B1) as well as tourism (B2).
When you have a concrete plan, you are going for a conference at xxx location on xxx date or you are going to visit your girlfriend in xxx city on xxx date then apply.
