Below is the error it's giving me. I only applied for the DS-160 this Saturday, the 16th, so I'm not sure if there's a delay. I'm going to wait a couple of days and try again. I guess my DS-160 is not in the system yet.

If you had plans then why did you not know how long he wants to stay? Did he not have a return ticket booked...with a return date?
Your replies to the questions sound very suspicious, seems he was lucky to get a month instead of being refused entry.

I don't know about India but here in the UK I made the payment online when I submitted the DS160, and also selected an interview date at the same time.
She needs to being proof of her ties to her home country, as that is what the CO will want to determine at the interview; for examples just do a search there are a number of topics with the information.

It depends on the consulate. They may accept the application, but have no obligation to do so.

I can't remember but most airlines allow children from 5. I just saw your post that yours is 4 so I guess that is not an option right now but will be from their next birthday.

When I was a young kid I travelled plenty of times by myself, being escorted by an airline or airport employee, can't quite remember which, for a fee.
Your sister does not need to travel.

Make sure that in every visitor visa interview they state that they need the visa because they're coming here to live and take care of a child. Also make sure that you write an invitation letter that USCIS can keep on file indicating that their services are needed for long term child care.
Don't be afraid to apply for both the MIL and the FIL. Regardless of how smart they are or their profession, everyone is eligible to apply for a visitor visa. They can also provide information as to what year they plan to return to their country, if at all. This will help greatly in the decision making process.
An army contract never hurts, especially to really drive home the point to the CO that they are truly needed for child care.
NGO or non-NGO (assuming you mean Non-Governmental Organization) doesn't make any difference in the visa approval decision making process.
Im assuming this is advice to make sure the OP's in laws fail in their application for the visa, yes?

Why would they care how long you are away from your wife for? That's your problem not theirs. Their only concern is if they give her a tourist visa, she returns and does not stay.
Her chances are slim, but there is nothing to lose in trying apart from a few $$, so let her apply and she might get lucky.
If not then just meet up in a 3rd country such as Mexico.

No.
A tourist visa simply allows them to arrive at the US door and ask for permission to enter, so to speak.
Once they arrive at the Point Of Entry, their length of stay will be determined by the CBP person. There is no guarantee of entry, they can be denied entry and sent back, or allowed to enter anything from 24 hours to 6 months.

we are going to process the tourist visa and have mother inlaw come stay with us for a while is all. if she cannot work we will not let her work. I am not going to tell her she cannot play with grand daughter while she is here either.
we will not know until process the papers and she goes for an interview. Right?
When she goes to her interview just make sure her answer to the question of what is the purpose of her visit is not 'to look after my grand daughter' as yes technically that is considered work so it will be a swift denial.

So you entered in August under the VWP and have not left the USA at all since?He is on a temporary working visa for 10 years.
I entered the states in August on an ESTA I had previously obtained. The 2 years completely ran out in November so I was able to apply for a new 2 years which started in November. Is the consensus here that it is better to try and stay here 90 days at a time until we are married, rather than apply for a b2?
If I apply for a B2 and it is declined, will there be complications once we are married and I am trying to enter on my fiance's visa?

What do you mean you would have been there 6 months by January?
An ESTA is just pre-authorisation to use the VWP, and it lasts 2 years at a time. On the VWP you can only stay 90 days at a time, applying for a new ESTA does not change that.
When did you first enter the US on the VWP on this trip?

B2 application has no effect on K1.
And seriously do not buy any ticket before having the visa.

OP, did this customs person say within what timeframe he was referring to? Maybe he was suggesting if you were to come back again any time soon.
After a 5 month absence I think you will be fine.
