    What are you filing for? Your profile says AOS, which would be within the US, but you have nothing in your timeline filled out, and did not provide details in your post. This is also posted in the 'What Visa Do I Need?" forum, but if you are filing for AOS, then you are not in need of a visa.
    Medical exam abroad for getting a visa is valid for 6 months. Medical exam in the US by a civil surgeon(I-693) is valid for a year.

    My husband and I used only assets. Make sure you can show ownership for some time along with official value. Assets must be three times the poverty guidelines for your household size plus a couple of thousands for good measures.

    Yes, you need to send the appraisal along with the I-864, and I would list it anyway since the I-864 instructions state you may list the value of your home. Best to list all the assets you have when trying to get it accepted on assets alone. You can list all vehicles except one that works, as stated in the instructions. You need to show that you own all the vehicles and are listing all but one of them.
    As far as I have seen, the USCIS adheres to the I-864 instructions when adjudicating for AOS far better than the NVC and COs for a spousal visa.

    Only assets that can be converted into cash within one year and without considerable hardship or financial loss to the
    owner may be included. The owner of the asset must include a description of the asset, proof of ownership, and the basis
    for the owner’s claim of its net cash value.
    You may include the net value of your home as an asset. The net value of the home is the appraised value of the home,
    minus the sum of any and all loans secured by a mortgage, trust deed, or other lien on the home. If you wish to include
    the net value of your home, then you must include documentation demonstrating that you own it, a recent appraisal by a
    licensed appraiser, and evidence of the amount of any and all loans secured by a mortgage, trust deed, or other lien on the
    home. You may not include the net value of an automobile unless you show that you have more than one automobile, and
    at least one automobile is not included as an asset.

    It is based on when you get the greencard, so if the approval date is on or after your two year anniversary it will be a 10 year card.

    Your going to be fine, don't worry, You mentioned you have copy of your I94, that proves you entered legally.
    Now since your married to a US citizen, your overstay will be forgiven, one less thing to worry over.
    Just have your evidence for a true marriage to send with your documents, Joint check-savings, joint credit cards, on his health insurance, joint utility bills, on mortgage or lease , Will and life insurance showing the other as beneficiary, mail address to both of you, such as Christmas cards and or New Year cards. Birth certificates of any children born of your marriage.
    Stop fretting and get busy with evidence and paperwork....... Best wishes on your new journey

    You are good. I have been here 20 years on overstay, lived with my boyf for 18 years and now that same sex marriage is legal we applied and we are schedule for our interview next month.

    You are good to go then:) Overstays ARE forgiven when married to a USC no longer how long ago you entered, as long as you entered LEGALLY! i doubt it would even come up at the interfview so no need to go in detail about it. The good thing is, once you file you will get a EAD work card in about 3 months.. i know people that were here 10yrs as an overstay and found love and married.

    if you are married more then 2yrs you will get the 10yr greencard instead of the 2 year conditional so you wont have to do Removal of Conditions:) so that is a bit of paperwork and $500 you save!

    You take it to have it valued by a professional. There are people who specializes in that. How did you acquire them? If they're valuable, you should have a receipt of purchase or if you inherited them, a will of some sort or a statement from the lawyer executing the will.

    It's been years since I owned any precious metals but I recall having a receipt of purchase which also doubled as some sort of certification, i.e. X ounces of Y precious metal. That seems like it might be sufficient if your bullion is in a simple bulk form, as you can then simply apply the current trading price of the metal to obtain the current value.
    If you have some sort of medal, coin, or other distinguished form of the metal, you'll probably have to get it re-appraised at some bullion dealer. I'm sure they would provide some sort of certification that could be used for immigration purposes. Good luck!

    Using assets for the 864 can be difficult and not everyone qualifies. There are specific rules they use to determine if it (the asset you claim) will be allowed. Its not just add up things you have that total 60K.
    So for your home- if its your primary residence then forget using it. It wont be allowed. Its considered a hardship to lose your home.
    3 cars and 1 bike- Perhaps they will allow 1 of the cars since you are going to be 2 drivers and will each "need" a car/ This Im not sure of because no one really tries to use cars as assets unless they have a car collection of antiques or race cars or something like that. Anyway if you want to try to use the car you would need proof of value like kelly blue book plus proof of ownership.
    Stocks- this is commonly used and sometimes allowed and sometimes not. Is it part of a retirement plan? Because sometimes they disallow that as its a hardship. If not then you need proof of ownership, current value etc. Depending on the value they can decide it is not liquid enough OR the value is unstable.
    Metals-- Im going to assume its similar to stocks you should have some kind of proof of ownership and value.
    You would send everything in with the 864 or RFE. If its an RFE you wont get another chance if denied. If its the initial AOS you will get an RFE.

    Thank you for your suggestions! That sounds like a lot more running around she has to do and unfortunately she has no car... that's the problem. Her harassment is on the bus she uses- and there's only one bus line out of her suburb.
    I am considering paying to have her tablet repaired so she can have a good way to contact me and friends, use some check-in apps with panic buttons if she's in a bad spot, and you have a point- maybe if she can quietly record what's going on and get a shot of their faces (sometimes they lean in to whisper threats) she can bring it to the police and have their asses arrested if they try anything dumb.
    I am also considering getting her a whistle or air horn that she can carry around- do any aussies know if a swiss army knife would be legal to carry, or an air horn? Obviously zero intent to cause trouble at all, a last ditch effort if she's actively being physically attacked. I have zero idea how the Aussie court system works, however. An air horn technically wouldn't do any damage except to ears but she could use it to cause a ruckus! I carried one of these when I was presenting as a woman and they worked beautifully.
    The staying with relatives thing is a great idea. Sadly, her parents are in a dangerous neighborhood as well but she has a dear friend in a poly relationship and plenty of couch space she can crash with if she knows she has a bunch of stuff to go to that week- they're right near her Dole assignment, Tursa, and that bus is past the dangerous point for her therapist.
    Thank you so much for the concern and suggestions! I am open to literally any ideas from anyone and will carefully weigh options. Again, we have zero intents of endangering her chances of fixing the problem forever. I have a car and zero problem with bringing the thunder if anyone messes with my sweetie from down under. >:c
    And at the end of the day, it's nice to know people care. It's nice to know other people think this is ridiculous. I am not a religious man but I am sending out all my positive intentions that everyone gets their visas and adjustments quickly and with no fuss. Here's to all of us trying to get into better situations, and a special shoutout to anyone else trying to help their sweeties or get out of a dangerous sitch themselves. <3

    Assets are optional, so never need to declare any. If you need to use them, you can list whichever ones you choose. However, if using only assets, then you may wish to list as many as you possibly can. You need proof of ownership and net value. Property needs an appraisal as well. Check the instructions for details on using assets.

    "In order to qualify based on the value of your assets, the total value of your assets must equal at least five times the difference between your total household income and the current Federal Poverty Guidelines for your household size, however, if you are a U.S. citizen and you are sponsoring your spouse or minor child, the total value of your assets must only be equal to at least three times the difference."

    You need 3 times 125% of the poverty line, so about 60K.

    I think the best way to solve this is you and your wife go to a court get a marriage license, and then get married again in front of the judge. Is fast and is not expansive. And will help you to avoid be denied, because you will be legally married in the US. You can always attach your wedding pictures that prove that you did a religious ceremony before.

    Hi,
    I will try to help you. Looks like you will need to fill it out two forms of I-864, one will be for your wife and the other one will be for your mother-in-law. If I understand correctly your mother-in-law will not live with you. But, if she will be living with you than you don't need two different forms of I-864, because she counts in your household, and her income counts in your household income. The same with the child, if he/she will live with you guys the kid counts in your household size, but, if not you don't need to count in your household size.
    In the part six I would put your wife as unemployed as she doesn't work.
    In the part they ask about other incomes you are using, you will just mention your mother-in-law's income if she will be living with you guys, if not, you should not mention here income in your wife I-864 form.
    About your wife's name, you should use her actual name. If her name changed you should use the changed name and just put her maiden name if they ask for it.

    Just say B2 visa holder. If they want to, they can figure out your I-94 expired on their own since for US citizen spouse it's not relevant.

    Yes you can stay here you just have to adjust your status and ask for your residence only if your husband is a us citizen I did the same thing came here with a visa in 2006 and got married in 2009 and now I'm a US citizen.
