Should I follow 2 year anniversary of residency or card expiration date

Hello everyone,

I entered the US in Oct, 2014 and had got my GC with an expiration date of Oct, 2016. But, there was a name error in my GC and I had to send it back to USCIS for correction. It took about 10 months after that for me to get the new Green Card with my name written correctly. The expiration date on the new card now became August, 2017. That makes it almost 3 years of residency.

Now, to apply for removing conditions, should I follow the expiration date on my corrected Green card (August 2017) or the actual 2 year anniversary of my residency (October 2016)?

Keen to know your thoughts.

This is a unique situation. I would have thought your residency date would be independent their mess up so I'm surprised they gave you another later date and not just a new card with corrections and the old date.

Yes, that's what I thought too. The expiration date that I have now seems to be 2 years from issuing the new GC.

That is a unique situation. My understanding was the Removal of Conditions is supposed to be submitted by the 90 days before your 2 year anniversary of POE. I wonder if there is someone you can call to clarify. Would hate for there to be two dates somewhere for you and you missed doing something because someone somewhere messed up on the GC....or maybe they didn't mess up, but better to get someone to clarify. maybe USCIS directly?

Yes, I am going to try calling USCIS today. It has been difficult getting through to them the last couple of days that I have been trying.

They screwed up by extending the card. I saw a similar case a while ago. You need to ROC for the original date of the GC. The new one is a mistake.

I finally got through to the USCIS helpline and the person I spoke to has asked me to go by the date I have on my reissued GC. I will try calling again tomorrow to be doubly sure and see if I get the same suggestion from whoever I am talking to.

I posted a similar case on the forum a couple of weeks ago. I am having the same issue with my green card. The 90 day window period for ROC is open but my green card doesn't expire until some time next year. This is because the original ones were not delivered by the post office and we had to re-apply for re-issuance. When the new ones came, they had a different date on them, giving us almost an extra year of validity. The impression i got from the forum was that it was a mistake on USCIS side. So, I am seeking to make an Infopass appointment to clarify everything. Please keep me posted if you come up with any solid answers. I will keep you posted too.

I would do ROC 2 years minus 90 days from the original LPR status (so for you when you entered the USA.) For a K1 this would be different as they have to adjust their status so POE would not be when their LPR status started.

Am glad to hear from someone in a similar situation. I am going to call USCIS once again tomorrow and see what they have to say. I did call once today and they asked me to follow the expiration date on the Green Card, but I want to be sure by checking what another executive may have to say. Will keep you posted.

Thanks for your response. I am planning to check with USCIS once again before deciding what to do. Even though I had spoken to them once today and was asked to follow the expiration date on my current GC, am now not sure if I explained the situation clearly to the USCIS executive on the phone.
