I-864, who has to file in my Case?

Good Morning fellow Vjers!

i am prepping the AoS Package at the moment and i am stuck with the i864.

I am the Benificiary, my Wife, the Petioner is a Student and our Sponsor (my mother in law), which would be the "only joint sponsor", if i stand correct.

My question is do we have to file two I864s like we did when we applied for the K1?

Also my Wife has 1 Child, which is currently living with her Mom (my mother in law). -> Which makes me wonder how to fill out Part 5 (Household Size)

Since she is a Student how would Part 6 and 7 look like?

Are we using her maiden name or new Last Name on all the Pages?

It would be nice if someone could walk me through this.

Hi,

I will try to help you. Looks like you will need to fill it out two forms of I-864, one will be for your wife and the other one will be for your mother-in-law. If I understand correctly your mother-in-law will not live with you. But, if she will be living with you than you don't need two different forms of I-864, because she counts in your household, and her income counts in your household income. The same with the child, if he/she will live with you guys the kid counts in your household size, but, if not you don't need to count in your household size.

In the part six I would put your wife as unemployed as she doesn't work.

In the part they ask about other incomes you are using, you will just mention your mother-in-law's income if she will be living with you guys, if not, you should not mention here income in your wife I-864 form.

About your wife's name, you should use her actual name. If her name changed you should use the changed name and just put her maiden name if they ask for it.

No, she is not living with us therefore i am absolutely lost in how to fill in Part 6 and especially Part 7 for my wife.

i think if i attach her acceptance letter from her school, a letter where she explains her situation and maybe med school transcripts. we'd be fine....

2. If she has some source of income you need to put how much she's making, if she doesn't have any income whatsoever you need to put 0 or none

3. When they ask the name of the persons that you are using income from, since is nobody that lives in your household you will left in blank or put none in the name of person 1, 2, 3 and 4.

In the question 15 you will need to sum all the incomes that you are considering in that 864 form. If you are talking about your wife just her income do not mention your mother-in-law income because she will not be living in the same household and she will need another I-864.

Part 7. Your wife has some assets that you are counting on to live? Or you guys will live just with what your mother in law provide to you guys? If she has some sort of income put how much she has, if she doesn't have any put zero.

You will need to put how much money she has and check and savings account in the number 1

#2 The house that you will be living is rented or she owned? If she owned you need to put the value that she already paid for it.

#3 - If she has some sort of other assets you need to put how much she has there.

#4 - You will need to add together the sum of what she has in her bank account and other assets. If she doesn't have any money whatsoever put zero.

5.a - Say none.

5.b - Say zero.

6. If you have some sort of savings put how much you have in you bank account there.

A letter where she explains her situation will be good. I don't think you need to put a letter from her university. But you can, if you want to. Is a prove that she is a student.

She doenst have an income. its all student loans.
