ELOE got a reaction from Justicemum in VAWA - AOS- Notice of Intent to Deny. Success!
Hi Everyone, I am posting a summary of my journey, specifically of why I received "Notice of Intent to Deny" Even tho I was a VAWA applicant.
1- My entry status: F1 Visa, Married to us citizen, it was his idea to bring me here first as an international student and switch the status.
2- During the 2 years of marriage I was abused by my EX and he was threatening me to cancel the green card application all the time.
3- My initial I-485 based on marriage was denied because I was accused of "Willful Misrepresentation" as I didn't attend the school, My Ex didn't let me go to school.
4- I left my Ex and filed a divorce and learned about VAWA. I had strong evidence including police reports.
5- I received RFE because of the same reason ( Misrepresentation) my lawyer sent more evidence and explained the circumstances of why I didn't attend school.
6- Within 1.5 years my VAWA was approved. Got my EAD and my lawyer filled I-485.
7- Withing 1 year I received a notice for an interview. I attended the interview with my attorney, they couldn't find the jurisdiction letter in order to make a decision, the officer said they will try to find it.
8- My lawyer filled FOIA.
9- After 9 Months, we received a favorable FOIA report and my lawyer submitted it to the officer.
10- After 6 month, Jan 2019 I received "NOID" because of the same reason "Fraud- Willful Misrepresentation" at this point, I was certain that the application will get denied and they will ask me to refile again with a waiver.
11- Feb 28, My attorney responded the letter and explained the circumstances again, we submitted evidence that I had good intention to attend school but it wasn't up to me, my ex was controlling everything. We also submitted evidence that I attended a different school and other evidence to show I am in the process of attending grad school, I tried to submit everything that could possibly prove that I had good intention to attend school here int he U.S.
12- March 23, My I-485 was approved.
13- March 29, My Green Card arrived in the mail!!

Hi,
I have a similar case, i360 and i485. Neither I360 is approved nor I got an invitation for an i360 interview. 2 days ago, I received an email for i485. But it doesn’t say approved or denied. In the email, it says Your case status: Decision. I assume Denial or Notice of Intent To Deny is coming. When your i485 was approved, did the email say that it was approved?
Thanks and congrats
A.

ELOE got a reaction from JoannaV in I-485 Case was Approved! Vawa based
Hi Everyone, I was checking the status on my case yesterday ( After Me & my lawyer responded to the intent to deny letter) and I found this!!!!
On March 23, 2019, we approved your Form I-485, Application to Register Permanent Residence or Adjust Status, Receipt Number EACxxxx. We will mail your approval notice." - I literally cried for hours after seeing this, I was hopeless and certain they're going to deny my case. Definitely, Vawa is so forgiving! There's a chance to get your green card with approved Vawa & without filling a waiver. It has been 10 years... I am finally going to see my family again
FYI, the decision was very quick! I sent the response on Feb 28 a decision was made on March 23rd! Less than a month...
