  1. Agreed, the way I read it was that her expectation in the relationship was that they would be living in her home country and that a move to the US came up after the marriage occured.

  3. Think of it this way... if you were to have a religious ceremony, would you be free to have a religious ceremony with anyone else? I assume the answer is no. The K-1 requires you are "free to marry" therefore, since you would not be free to marry, you would not be eligible for the K1 visa. Simply put, don't do it.

We just walked out USCIS Office, explained to her what i told everyone here, we gave her a letter withdrawing form i 485, then gave us a letter explaining the refund process, also gave her the new form i-824, reviewed it and sealed it, gave us a letter that they have the form and said just wait for letter in the mail for interview date. It does not work like that... File will now need to be transferred to NVC (+/- 1 year) then beneficiary/petitioner will need to complete personal and financial info, which will get them documentary qualified (DQ) (several weeks to months) then NVC will send to Manila for scheduling an interview (no idea what the wait time is for Manila).
  5. FYI.. I-824 took us well over a year to get processed and probably another 3 months to have the file actually sent to NVC. You will be waiting a long time.
  6. The only time my wife and I wear our rings is when we are going out to a party or a special dinner. No one will question why you don't have a ring on. You have nothing to worry about.
  7. Sorry, I misunderstood your post. You're all good. Like others said, affidavits are next to worthless. Just concentrate on providing proof of being together and communications between the 2 of you to show the relationship is real.
  8. Zoom does not equal being together. You have to be in each other's physical presence at some point between the wedding and filing the I130.
  9. You cannot file a 601 until you have been found inadmissible at the interview. If the lawyer knew about the drug conviction he should never have let your husband leave the country, or at least should not have had you spend the money for the 601A. I always assume the worst about lawyers... if he knew about the drug conviction and allowed you to file a 601A, he was counting on getting fees for 2 waiver submissions from the get go.
  10. I can think of one benefit... Hold off on the divorce until he asks for it and then get as much money out of him as you can in agreement for the divorce. Since he will need the divorce in order to AOS through the girlfriend, it will be in his interest to pay up...
  11. You are correct. The I130 will sit at USCIS waiting for AOS until you file I824 telling them to send the file to NVC. We had a similar situation. Our wait time took approximately 18 months. Hopefully processing times are coming down and yours will be shorter.

  14. I think that OP is concerned that USCIS will consider the marriage to be fraudulent if it ends in divorce, rather than claiming that someone committed fraud.
  15. You could go to Thailand, meet and get your I129 filed long before your tourist visa is processed and, most likely, denied. "Those immigration people" have EVERY reason to distust you.
  16. Have you considered filing for AOS after getting married? Sounds like circumstances may have changed since her arrival....

  18. Does this attorney specialize in marriage based immigration or corporate based? (Large firms are more likely to specialize in the latter, so I ask..) I'll only add that I have seen many similar cases be approved with little to no issues.
  19. Without getting too far into the weeds, Your nephew knows the letter of the law, but not necessarily the practice of the law. Consult someone who has real world experience.
  20. Does anyone know approximately what DQ month is being scheduled for IR1/CR1 interviews currently?
