    If she has A PREPONDERANCE OF EVIDENCE then she should get the order.  If nothing "bad" ever happened she wont have this. Once again it seems you dont want to fight it because you are guilty. If this is the case then you are just spamming VJ complaining about her manipulating the court system.

    You haven't answered the question. The reason I ask is because the advice given here is provided altruistically, at no cost to you, by people who are going through or have recently been through the process who just want to help others to reach their goal. Please do not create fake questions. It wastes the time of the good people here who are trying to help and may also mean that genuine questions go unanswered.
     
    In 2015 you claimed that you couldn't even enter the USA without a visa because you were refused under the VWP in 2014 under very bizarre circumstances (including false claims of fear of return, despite being from a VWP country). In fact, the reasons for your VWP refusal made a B-2 approval very unlikely. In order to become a USC through naturalization one must first be a permanent resident of the USA for a minimum of 3 years (if filing as the spouse of a USC), ordinarily it's 5 years. Either your previous threads were fabrications or this one is. Of all of them are. It is simply not possible to become a USC in the timeframe you have given. We are all very familiar with the process and timeframes. 
     
    You also claimed in 2015 to have petitioned for an alien fiancée who got as far as interview stage and was subsequently placed in AP. This claim was made not 4 months after your claim that you were inadmissible to the USA. Again, it's just not possible for both claims to be true.

    I am sure there are rumors but don't believe it unless USCIS officially releases a statement. Historically they moved away from conducting I-751 interviews. If you go to page 19 of this document https://www.dhs.gov/sites/default/files/publications/cisomb-conditional-residence-recommendation-final-02282013_1.pdf ; the bar plot shows the distribution of received/approved/denied/ and interviewed cases over years. In 2008 the approved/transferred ratio almost looks like 2:1; that's crazy. In 2009 that rate dropped further, and in 2013 it looks like the ratio was 8:1 ratio that suggests only 10-12% of the cases get interviewed.
     
    I-751 is a burden petition; pretty much everybody gets approved. official average time an officer spends on a I-751 case is 0.99 hours; so why increase the workload of field offices with something that would almost always get approved? That being said given the backlog in both service centers I wouldn't be surprised if they implement some radical changes such as give conditional GC to couples that only exhibit higher fraud risk at the AOS status and reduce the number of people who file ROC; right now that only depends on the length of the marriage. If you are married for 2 years by the time you get your GC; you skip the conditional residence.

    hI everyone - just checking.  Does not look like everyone on this thread is Oct I-751 Filers.  Those who are - any news for any of you?  Last time I called they were still working on June 2016 filings.  Planning on calling again this week.  Just want to make sure I'm not all alone here the only one thats not heard anything.  Thanks so much! :-)

    While I will admit that I didn't see much progress in the forums last week, the week or so before that there were a whole bunch of June CSC filers approved, and May applications are starting to get approved at VSC. I suspect that one way or another, USCIS is putting pressure on VSC to get caught up to CSC (and might, to be honest, be holding back approvals at CSC until VSC is caught up. You can never guess at their motives. 
    Since people on VJ have not been updating their timelines (they're pretty good about updating in the monthly threads, but not the timelines, which is where the data is gathered to populate VJ's processing times charts), and (more importantly) since we at VJ (and, by extension, Trackitt) represent a tiny, probably statistically insignificant segment of the people filing I-751 it's hard to really have a sense of what's happening at USCIS.
     
    For example: in 2013, the year I applied for CR1, there were 248,322 people who became LPRs using the spousal visa. Let's assume 25% of them were CR1s as opposed to IR1s. (Which is a pretty conservative estimate) So 62000 people had to file I751s in 2015. That's about 5167 per month. In my monthly I-751 forum there are about 45 people on the spreadsheet. So that's 0.8% of applicants. Not really very many, if we're trying to figure out the larger pattern.

    I've been married almost 8 years to an Egyptian and have lived in Egypt for the entire duration. Living in Egypt all this time I've met some truly great, honest, and caring people, but I've also met scammers, thieves, and downright just plain devilish people. Most Egyptians are extremely family oriented and involved with with one another. I would be cautious about adding him to your bank account as you are not married.
    I hate to say it as I've seen it done; but just because you met his family once, does not mean in any shape or form that they would truly accept their 27 year old son to marry a women in your age. ( I mean this in no offense to you personally, I've just known this to actually happen and the women like yourself was left devastated and embarrassed in the end. )
     
    If you truly believe your relationship is genuine, then like the advice given to you before, go and live with him for some time in Egypt. Marry him in Egypt and have your wedding party there with his family & friends. Stay in Egypt for a few months and begin the CR-1 process, and then you can return back to the US. If you say that you can not live in Egypt for a long period of time due to your disability, then make a trip that last's for a few months at least.

    Your ex had a baby just in the time you married someone else ? You appear to be either rushing into relationships or dipping your stick into two ponds. Either will not look good in immigration eyes. Not only do you need to pay your own rent but get that DNA done and start supporting that child.

    If I remember correctly, it didn't take long to hear from back th embassy. I think it was only couples of days so you should hear from them back soon.

    The President has to work with both sides of the house on these issues so blaming the problem on one individual is ignorant of the system of government we enjoy in this wonderful country.
    The real problem lies in the fact that these Congressman and Senators have done nothing for over 60 years about immigration reform. This means there has been quite a few Presidents in that time so I see no reason to blame Obama now. The system has failed the people because the citizens have allowed these lazy politicians to do what the lobbyists demand not what is best for the people. We need to ask how these same politicians have remained in the same office for so many years. The answer is simply apathy and ignorance. I read recently read the 87% of the citizens say they are tired of the inability of these politicians to affect any significant change in any of the serious issue we face in this great country.

    Okay. I understand you are frustrated but no need to cuss and be rude. I was only providing the NVC process because any day you could be approved and I was just showing you the document so you can get your documents together.
    No where on the government site do you read its guaranteed 5 months. You could be in security checks, extended background checks, waiting to be adjudicated. And everyone knows Nebraska has basically stopped even doing petitions. Like I said the USCIS 5 months is the average I was talking, not VJ's predictions.

    I have experience with this - been in Japan 7 years, earning money but not enough to exceed the foreign income exclusion.
    I think you're getting confused because of the particular phrasing, "exempt from filing taxes." As a US citizen, you are NOT exempt from filing a tax return. You are, however, probably exempt from paying taxes on what you earn.
    You still have get a record of how much you earned overseas (if you are working for a Japanese company, this will be on your 源泉徴収票/gensen choshuhyo; if you don't get them or lost them, there's an IRS form that will allow you to use an estimate of your income along w/ a letter of explanation as to why you think that estimate is accurate). You convert your Japanese income to USD (Google is fine for this), and then report that number to the IRS. If, like me, you haven't earned enough to exceed the foreign income exclusion - which as mentioned above is something like $90k - you can file a form 2555 to have your foreign income excluded from taxation by the US government. That means your gross income will end up $0.00. Voila, no taxes!
    If you haven't been doing this, the good news is you can still do it now. I got lazy and didn't file taxes for like 3 or 4 years. This would usually be fine, since your income is $0.00 - if you don't owe anything, the IRS generally won't bother you. (This might be why H&R Block said don't worry about it.) However, since we're sponsoring an immigrant, the IRS is going to get nosy about our income - so you've got to turn in your $0.00 tax returns for at least the past 3 years to prove that you never owed them anything.
    Then you will fill out the i-864 with your $0.00 income and your mom will fill out her joint sponsor form with her income.
    If you search these forums, you will find this exact question from many, many people in Japan who haven't been bothering to file their tax returns. The advice to them is always the same: you should turn in your $0.00 tax returns for the past 3 yrs in order to do the i-864. Just doing it is actually probably easier than stressing out about contacting H&R Block and worrying yourself sick over whether or not your letter of explanation will make NVC happy.
    One tip: if you turn them in and at the same time mail in a request for transcripts of those years (here: http://www.irs.gov/Individuals/Get-Transcript), they will get done very quickly!

    Regardless of where you live, being a US citizen requires that you file a tax return with the IRS. Don't know where you got the idea being outside the US, and not earning income in the US makes you exempt.
    You both need to fill out I-864 forms, you're the petitioner and always will be a "sponsor" and responsible for the immigrant you are petitioning for, even if you don't make the 125% threshold. Your mother will be a joint sponsor, and will be able to help sponsor for the principal applicant.

    Plus, your income will be 0.00 if the income you're receiving in Japan is going to end once you move back to the US.

    I've not taken a complete break from VJ - I read it religiously. But after a Friday night meltdown three weeks ago, I've started calling NVC once a week only (on Friday nights). I still love reading about people here, and I try to pass on any hints - but I had to come to the same conclusions - no matter how angry or upset I was at the fact that NVC made a mistake, I was still going to have to wait until May 9th mail was processed.
    We will never be able to get back the 4-week delay - we can only hope it won't turn into something longer.
    I think next week will be a big one for a lot of people on this list (me included!).
