OK, so you seem to be saying that the people in Russia are evil. That is just a little to generalized for my tastes. Yes, Putin is a thug who does not want to give up power, he is corrupt and thrives on power, but don't paint everyone in Russia as Putinites. Sure a lot of folks there do like a strong leader no matter how it looks to the enlightened Davos crowd. That is really an interesting take. I must admit when I first joined VJ, I had fairly strong feelings about AOS from B2/ESTA et. al., but those have changed over time. I know, it allows people to jump the line, and more than likely 80% or more of the couples or people (other IRs) doing it probably decided to do it before entering the US, but there are times when it is really necessary. My thought is that Congress needs to change the law to allow an AOS interview to also include another entry interview and the beneficiary (and petitioner) has to prove there was no pre-planning to this.

So yes, apparently early in her schooling she was promoted even lacking reading and writing skills, but that changed eventually. I have seen this create confusion within USCIS. If submitting an IRS transcript, there is no need to include any W2's/1099's as that information is included in the transcript, but since he included a copy of his W2 in the RFE response, USCIS appears to be looking for a copy of the return (1040, 1040A, or 1040EZ) that was submitted to the IRS which is not the same as the transcript from the IRS. I know, it doesn't make any sense, but that can come from a bureaucracy. I agree with @Demise, file the I290B with the copy of the 1040 form submitted, or start the I485 all over again (I would do the I290B it it were me). As to the denial, it is more about not responding to an RFE properly at least according to USCIS. Generally speaking, if an RFE is issued, that is the petitioner's/beneficiary's chance to correct a mistake in a petition, if that is not correctly done, the case is denied, and USCIS moves on. It seems your nephew needs to file an I290B. If the RFE was answered properly and within the time period, the I485 should be re-opened. Good Luck!

Was this an immediate denial after filing, or was this some time after? Again, if you have items requested in the bulleted items, you can try the I290B route to keep the EAD active. We need a little more detail regarding the reason for the denial. Did you receive an RFE that was not responded to? Was there an interview where information was requested? If the I485 was denied and you received a notice of the denial, then yes, your only options are to either file an I290B or start again with a new I485 package correcting the reason for the denial. I would look at both options and especially the I290B as that should keep the EAD active, but a new I485 filing would mean needing to file a new I765 for employment authorization. Good Luck!
