I saw the 60 Minutes piece where the German prosecutors were saying people can be prosecuted for "offending" someone online and apparently a raid was staged showing their power. I agree the framers back in the late 1940s were very close to the post Hitler government and of course saw the atrocities committed by the Nazi Party, but it seems that the German government is expanding their enforcement powers.

Everyone is getting a 48 month extension letter now when the I751 is filed. USCIS progressed from 12 months back in 2016 (when my wife filed), to 24, and then 48 months. Whatever that "lawyer" stated is simply false, USCIS does not judge an I751 package when received and then decide to send out an extension letter to fit the case. Good Luck!

Just marrying within 90 days does not confer LPR status on a person entering with a K1 visa, they also have to complete the adjustment of status (AOS) process. If this has been completed, you really have no recourse from an immigration perspective unless you have concrete evidence she defrauded you to get the visa, and you are on the hook with the I864. If she hasn't completed AOS, then divorce and move on and again if you have concrete evidence she defrauded you for the K1 visa, you can report her to ICE. Good Luck!

They will not (or should not) take away the expired GC until she attends the oath, and she should have no issues with travel outside the US after the interview (my wife's card was taken away when she received an ADIT stamp, but her extension letter was expiring, so it made sense). USCIS will ask her about international travel between the interview and the oath at the oath ceremony, but if she is not close to the requirements she will be fine. Good Luck!
