Taxes are big for me as well, and I agree, despite how the Trump tax cuts are framed by most of the media, they benefitted a lot of people that are not in the 1%. Healthcare is a tougher one since much of that is handled by the states. I don't really see the US adopting a system like in Canada or the UK, but it would be nice to see the costs come down. What that means is that a person cannot AOS as there is no visa number available for the beneficiary. Numerically limited visa categories such as the family based groups (F1, F2A/F2B, F3, and F4) are limited in numbers each year. When an I130 is filed for someone in that category, it sits in limbo until nearing a time when a visa is actually available. When attempting an AOS from one of these categories, the beneficiary has to have a visa available before they can attempt the AOS. The same is not true of categories such as IR1, IR2, or IR5 that are no numerically limited.

It really depends on your plans. You mention she is currently in the U.S. planning on returning in 3 months. If that is the case, she can choose to AOS now assuming you have all the evidence to file, but the IV vs AOS question should reflect what your long term plans are. She cannot decide in a few months or so after returning she would like to come back to the U.S. and AOS as that would be fraud, so if your plan is to pursue the spousal visa, I would stick with that and she can use her B2, but she should be careful of abusing it (I.e short stays with more time outside the U.S. than inside). The online case status can alternate between Administrative Processing and Refused, but as long as it does not say Denied/Rejected you are still fine. As far as I have been able to deduce, Administrative Processing means someone is actively doing something with your case, but the visa has still not been officially Issued, and Refused means the case is still sitting in limbo awaiting all the rest of the work. Hopefully you will see the message "Issued" soon as it sounds like your interview went well. Good Luck!

To my knowledge, the Utah Zoom marriage is accepted at all consulates as long as you meet the requirement of meeting in person (consummating the marriage) either during or after the ceremony. Why not go to India, and do the Utah Zoom marriage while you are together? You can then submit the I130 as soon as you get the marriage certificate which I understand is done electronically for this type of ceremony. Good Luck!
