Phillip Kazuto got a reaction from Ian H. in NVC PD date is not current
Just want to add that applying for tourist visa will not affect your case whatsoever , approve or deny will not cause any problem to your pending case.

You can apply for citizenship 90 days before you have 5 years, so when you have 4 years and 9 months; be sure to count the days since it cannot go over this amount. As an LPR, your spouse has to wait for a visa to become available, the PD is basically your number on the waiting list.
Everyone with a PD before the cutoff date is eligible to apply for a visa, everyone after isn't until there is a new cutoff date, which changes every month. Now since you already petitioned your spouse, the petition is currently in process.
When you become a USC, which can take a good 5 to 6 months, you can upgrade your spouse's petition to IR1. As a USC, your spouse would have a visa immediately available because IR's of USC's always have visas available, it's unlimited, there's no PD to worry about.
As for the tourist visa, please not that once there is a pending petition, tourist visas are really hard to get. Your spouse has to prove really strong ties to Bangladesh in order to convince the CO.
The fee for a tourist visa is $160, if you are willing to spend that money, please note that you cannot get it back if your spouse is denied. Also, please note that your spouse cannot apply for a tourist visa for the purpose of staying in the US, it is visa fraud; otherwise for just visiting while the process is pending, is ok.

What category are you under? If you are referring to F2A, visas were current for a few months last year because there weren't enough applicants compared to visas, therefore the PD's were current. That may not happen again, at least not anytime soon.

Try to educate yourself how priority dates and visa bulletin work.
Right now people that applied in March 2013 will get their visas, and as the bulletin's PD for F2A moves forward, they will be getting theirs. If you apply today, you'll get yours in ~1.5 - 2 years. Of course that's all somewhat speculation, as no one can really predict the movement of the bulletin.

Waiting time is 1 year or more depending on the Visa Bulletin for F2A category. http://travel.state.gov/content/visas/english/law-and-policy/bulletin.html
Wrong advice because mother wants her child to live with her PERMANENTLY in the USA.

Phillip, I don't trust this man anymore. Not a long time ago, he was supposed to use executive action to pass some immigration law. The minute Democrats are said to loose the control of the senate, Obama threw immigration reform under the bus. Now, him saying "I will keep fighting" is similar to admitting that immigration reform will disappear from Obama agenda for his remaining years in office. Unfortunately, it is all about politics.

Phillip Kazuto got a reaction from Ian H. in LPR dad wants to add 2 daughters as derivatives to wife's petition
That's not true , she can't add derivative under IR5 which mean you'll have to wait till your mother go to US then file another petition for you and it will be F2A.
Make sure she file the petition as soon as she get into US just so your petition will be approved while you're still under 21.
If you're over 21 , then you will be in F2B category and the waiting time is long enough and you can't get married.

    hi
there are no priority dates when married to a USC, so you don't have to wait anymore once they have updated your wife's status, .

Phillip Kazuto reacted to Not a Tailor in Marry with a Green card holder
There is no fiancé visa for a greencard holder to sponsor a girlfriend or fiancé. You must be married. Whether you marry in the US or in her/your home country does not matter, but if she is able to get a visa and come to the US to marry you, since you have decided to bring her, she will have to return home to her country to wait. You are looking at about a two year wait to have her live with you, take or give a few months to a year. I believe you want to look up the requirements for an F2A visa, which I'm pretty sure is the spousal visa for a spouse of a permanent resident.

    1. Yes DS-261 is to choose an agent. Generally the petitioner is always chosen as the agent except if you have a lawyer attached to your case file from the beginning of the process.
    2. DS-260 is all about the beneficiary and yes the petitioner can fill it for the beneficiary.

I think a false checklist would not have any checks in front of the items and would not mention the first checklist. I would call. Who knows what they are doing over there. Maybe the first one was a false check list and you responded unnecessarily which caused them to review your response and cause the delay. They told me they go by the last submitted document because its a contract

No not at all , it ( the movement ) has nothing to do with the prediction
It's still too early to predict the movement at this stage of the month
Edit : We may be able to foresee the possible movement for November as early as around Sept 28th when ILs will be given to the current PD filers

So VB will come out next week , keep an eye on it peeps
Look like less movement because no Feb and up 2013 filers are reporting back about ILs , only Jan filers got ILs .
Normally a current PD filer will get IL by now i mean this time of the month without the need of waiting for VB to come out.

Phillip Kazuto reacted to clairegie in Visa journey WHAT A JOKE !!!!!!!!!!!!!!!!!!!!!!!!
It takes approximately a week for your papers to reach the embassy. Once the embassy receives your files, your fiancee will either get a call asking for her email or she will just get an email regarding the instructions on setting an appointment. The email usually comes 2-4 days from the time embassy gets your petition. If you want to verify if your files are at the embassy, you just need to call NVC.
Please try to look for similar threads about your concern. Your question has most likely been answered already on them. An example is this one: http://www.visajourney.com/forums/topic/462399-forms-needed-at-interview-for-k1-visa-in-colombia-and-i-134-questions/
