    I didn't say that. I said the State Department has preconceived notions based on a certain demographic or profile. The law states that everyone much be treated with immigrant intent to prove other wise. It is up to each individual to convince and change the mind of the CO that that is not the case. Maybe you have't heard of the stories of wealthy business men denied B1 visas for failure to establish strong ties who then set up their businesses in Canada or else where. If you scour these forums, you will find similar stories with similar questions and backgrounds. One was denied, the other approved. The law says that the decision is premade based on immigrant intent until that individual an convince the CO otherwise of your intentions, regardless of what your real intentions are deep down in the bottom of your heart. You essentially answered your questions.

    9 FAM 41.31 N2.3 Mere Suspicion Not a Reason for Refusal (CT:VISA-1034; 09-24-2008) Suspicion that an alien, after admission, may be swayed to remain in the United States because of more favorable living conditions is not a sufficient ground to refuse a visa as long as the alien’s current intent is to return to a foreign residence. I find this hard to believe given that so many people on these forums have expressed that their interviewers didn't even look at their documents and asked 3 or 4 basic questions already answered on the DS-160. 9 FAM 41.31 N3.1 Period of Time in United States Consistent with Purpose of Trip (CT:VISA-701; 02-15-2005)The applicant must establish with reasonable certainty that departure from the United States will take place upon completion of the temporary visit. . . provided that you are satisfied that the intended stay actually has a time limitation and is not indefinite in nature. So the CO determines the acceptable time frame to whatever the nature of the trip is, is how I interpret this.
    9 FAM 41.31 N2 RESIDENCE ABROAD 9 FAM 41.31 N2.1 “Residence” Defined (CT:VISA-1365; 10-29-2009) The term “residence” is defined in INA 101(a)(33) as the place of general abode; the place of general abode of a person means his principal, actual dwelling place in fact, without regard to intent. This does not mean that an alien must maintain an independent household in order to qualify as an alien who has a residence in a foreign country and has no intention of abandoning. If the alien customarily resides in the household of another, that household is the residence in fact. So for all those single, young men and women, who are just starting out with a job or have no job yet have sponsor that don't own property, a lot of them fit the type with weak ties then even if they have future plans that would bring them back to their home such as school or work. The statement above is likely ignored if you believe the post of people who have been denied for having weak ties. So again, who defines what a strong or weak tie is? 9 FAM 41.31 N4.1 Unlawful Activity While in Visitor Status (CT:VISA-1753; 10-21-2011)The law contemplates that an alien is traveling to the United States for legal purposes. Therefore, an application for a visitor visa must be denied in those cases where you have reason to believe or know that, while in the United States as a visitor, the applicant will engage in unlawful or criminal activities. That's basically in direct contradiction with the first law above because if the CO has any reason to believe in their professional personal opinion that the individual may be swayed to overstay their visit, i.e. breaking the law , because of weak ties home such as not owning a home (even though not owning a home is not considered abandonment under the law), not having a job, and being sponsored by another individual, you will be denied. It says believe meaning is in your opinion as the CO besides the obvious this personal will break a law. 9 FAM 41.31 N4.2 Adequate Funds to Avoid Unlawful Employment (CT:VISA-701; 02-15-2005) The arrangements which the applicant has made for defraying the expenses of his or her visit and return abroad must be adequate in order to prevent their obtaining unlawful employment in the United States. If some COs won't even look at the documents of people requiring sponsoring from people who say they are willing and able to pay, then clearly part of the law is not being enforced. And finally,
    FAM 41.31 N5 IMPORTANCE OF FACILITATING INTERNATIONAL TRAVEL You must be satisfied that the applicants have overcome the presumption of intending immigration. That alone speaks volumes.
    The only thing I can think of for a denial is 9 FAM 41.31 N3.2 Specific and Realistic Plans (CT:VISA-701; 02-15-2005) The applicant must have specific and realistic plans for the entire period of the contemplated visit. And honestly a lot of ones I have seen are kinda vague: I want to visit (insert family member), I want to see this city, I'm having a baby ( although I don't know how much more plan than that you can get).
    So I don't know how else you want to spin. That's my interpretation of the law how I read it, and based on what com mentors have stated as their own personal experiences, the law gives premeditated decisions that must be overturned by a CO.

    Ok, if you say so. I disagreed with your initial post, and you seemed to have some opinionated answers to what seemed like a cut and dry story that to me didn't have reason to be denied. But yet you argue with everything someone comments on and fully and wholeheartedly support the same system that people are learning to navigate to be reconnect with family members and special friends. *shrug* Whatever you say . . .

    That's a much better response than that ####### you posted above. Good to know you feel like a know it all since you've been through the process. Good for you. I'd rather have doubts and wait before entering a marriage than go blindly into without without stopping and thinking more on it, especially when everyone you know is against the marriage in the first place which they have no problem expressing. So what do you know? Nothing. Nothing about me or us enough to sit behind a keyboard and hand out judgement based on a comment on a public forum. A single sentence comment. Really ma'am? Realy? In that one comment you have determined my whole relationship with my fiancee? I asked for advice on using the best judgement on ensuring that you're not marry someone using you for a green card not ridiculing me for having thoughts of paranoia occasionally after reading the post above. Especially one coming from the same country I'm marrying a man from! You have a good night ma'am, and I hope in future when people seek advice from someone who has been through the process, particularly those coming from Morocco, you will have the decency at least find something positive to say than being a negative Nancy. Unless you have something nice to say that's contributing to the better of the overall movement of any particular post I suggest you keep your rude and mean comments to yourself!

    I have doubts because I read the stories on here about lying spouses while searching for other topics. none of you can lie and say It hasn't crossed your mind or find its way at the back of your head at least once, especially when everyone around you is telling you you're a fool for marrying some one from a foreign country. If it's one place i thought i could go without criticism or judgement, it's here. Marriage is a big life change and I don't want to just jump into it with our being absolutely certain I'm making a good decision, particularly since im marrying someone from a country of high fraud. Furthermore my fiance expressed interest in joining the air force so that he could start working right away, its easy work and why not serve the country he's going to make his new home? The judgement and negativity of the people who are supposed to be supporting others of the same experience, meeting and marrying someone from a foreign country, is really sad and makes question whether its worth anyone's time participating in these forums. . . .

    You know what? You’re right. I told my husband to call about 2 days ago to see if Aramex had his visa because we never heard from the embassy and all other track your passport options didn’t seem to work or be accurate. When he called, they said it was there and he went to Casablanca last night to pick it up. He now has his visa in hand.
    The down side is he has until December 1 to use it, but we’ll definitely do it before then.

    Won't she be more upset to hear that once you apply for the spouse visa, she will have to wait about 12 - 14 months for the approval?
     
    I don't understand why not just stick with the K1 visa, especially since it sounds like you've done most of the waiting already .. (5 months, might be another 3 to 4 months and you'll be done)

    Definitely go for another visit before you file, two if possible. My husband and I are prime examples of people getting screwed by Casa and whining about it for years on VJ. We have been trying to get him a visa to the US since 2013 and are still waiting. Our case is so clear of being the real deal. Don't think for a second because you're in love it's all going to be so simple and cut and dry. People who've played the game for years on here already know...  😒

    Don't waste your time. Morocco is stingy as it is with visas. Your best bet if you don't want to link up in Morocco is to go to Turkey or Dominica, Brazil, maybe Kenya. There aren't a whole lot of options for Moroccans and unless he's already traveled outside Morocco several times, he will - not it's unlikely, but will not get a B2 visa.

    I met my husband there on a work trip in 2012. We tried the B2 (visitor visa), the K1 (fiance visa), and now we are on the CR1 (spousal visa). So far, every one of them have been a bust and we are currently waiting for the embassy to finally issue the visa as of 2 month right now.
     
    My recommendation is, because you met online and Morocco is a high fraud location, to build a strong case by making a few trips over the next 2 years. Marriage is serious, and you truly don't get to know anyone until you spend physical time with them like in these cases. I know you said you guys have been together a year, but Casablanca is good for denying visas, especially B1s and K1s. I hope you are able to take something from my experience and save yourself not only time and money, but a lot of heartache as well. I will say though that the distance and the trials that you might face will be a true testament to how strong you are as a couple.

    I think the person is trying to say, consular filing which is when a married couple living in the same country goes directly through the embassy to file for a visa. I don't think that applies to you since you're doing an IR-1.
     
    On the other hand, administrative processing is normal for Egyptians. It could be a few days or a few months. There's actually a thread about it in the AP Forum specifically for Egyptians if I recall correctly. Mandatory is just saying that it had to be done, it doesn't denote a special type of AP or anything.

    Plan early for your trip,    safe hotels, areas,  where in Morocco is he?  Have you talked with any of his family and or friend?
     
    I'm not knocking Morocco, as I'm married to a Moroccan, but be careful, think with the head, not the heart.   They as any man can be so charming, and then a monster as fast as you can turn your head.   Take your time, know what is best for you and your kids.
     
     
    A visitors visa is hard to obtain, my husband had been issued a visitors visa twice, due to their band was performing here in the US, they were kind of a big thing there in  Morocco.
    I think that's the only reason he was issued the visitors visa twice.

    You've got some good responses and some wrong ones and some just misleading.  Rather than addressing the specific posts, I'll cover all the issues I think relate to the circumstances you describe.
     
    If the DS260 was completed correctly, the green card and Social Security card will simply arrive at the intended address given on the DS260 a month or so after entering the US. You do NOT have to be in the US for the visa to be issued.  Deployed military are considered as residing in the US for immigration related purposes.  Since in countries where AP is common, the AP itself might not be completed within six months of the medical, the visa validity will have no relation to the medical exam.  There are notable exception, like Manila, where AP is uncommon or usually short, where the exam date impacts the visa expiration but this is not generally the case.
     
    Your concerns about him being in the US without you will need to be addressed as you see fit.
     
    With those issues dealt with, you can focus on the real issue, which is whether the visa will ever be issued.  That will depend on the specific circumstances of your case, but if they don't usually do the AP security checks unless they otherwise intend to issue the visa.  
     
    When AP is complete, it's also possible to delay visa issue, or as already mentioned, he only has to enter the US before the visa expires, not get settled.  He can leave as soon as he wants and come back when you return from your deployment, provided he doesn't leave for significantly longer than six months.

Said it would take up to 2 weeks to issue the visa. As long as it is done by July, I don't care. After 4 years of this ridiculous immigration process, it's time for my husband to come home....

    Did the interview this morning, Imad was notified of his approval but told that his case would be in AP until they finish removing his K1 file from their system. Said it would take up to 2 weeks to issue the visa. As long as it is done by July, I don't care. After 4 years of this ridiculous immigration process, it's time for my husband to come home....

    I'm so happy to say, my husband's visa was approved this morning!! We're so excited that we've successfully gotten through this process. Good luck to all the June interviews, and to those waiting for July!!
