Entering the US on a nonimmigrant visa with the preconceived intent to remain would constitute visa fraud.

Income needs to meet or exceed the poverty guidelines of the I-864P http://www.uscis.gov/files/form/i-864p.pdf. If it doesn't you will need a co-sponsor. Other question is does your embassy accept co-sponsors with the K-1 visa? Some embassies can be difficult about this.

Do it the right way with her orignal signature please! DO not try other routes.. GEt it expressed mailed to you and you will get the package in less than 5 days.. Its completly worth the wait. You are from MENA countries which have higher chance of AP! I highly recommend taking every piece of document seriously and taking your time submitting it. Don't rush! If you rush, it will end up RFE or more problems!! Good Luck!

More tips on the interview below……
    1. Speak slow, and answer questions in detail. Stick to the question and don’t veer off the subject. Respond clear, and descriptive. Should not be longer than one minute to answer, but be sure to explain yourself.
    2. If you do not know the answer to a question, do not lie. Say, "I don't know the answer to that at this time." or "I don't remember."
    3. The answer to many questions will be in the papers that were sent in the petitions. Questions like, "what are your wife's parent's names". They will expect you to know the information given in your petitions. Review everything in your paperwork with your husband before his interview, and do a mock interview to see how the information may be applied.
    4. Avoid saying "I think . . .". Women do this a lot. The examiner will expect you to know not be unsure, of your answers. Alwife, avoid adding "umm", "you know" and "ahh" type fillers to your speech.
    5. When applicable, don't just state, demonstrate. If the examiner asks a question that can be answered with a document or photograph(s), provide it along with your answer.
For example, if the examiner asks, "What does your family think of your wife?", give them a picture or two with your answer; "They like her very much. Here is a picture of her with my mother at my home."
Or, "How many attended your wedding?" Answer, "(give a number, then say) We have wifeme lovely wedding photos of our guests having fun. Here are a few that I can show you."
    6. Give American answers for dates and times. 12/24/07, not 24/12/07.
    7. Dress well, but not overdressed.
    8. Try to appear calm, well organized, and friendly. Nervousness raises suspicions.
    9. Remain focused. If the examiner makes jokes, smile and enjoy, but do not make jokes too.
    10. Make proper eye contact when conversing with the examiner, and try to control your own facial expressions assure that your face remains pleasant and cordial.
    11. Be audible (means speak up) your examiner doesn't have to ask you to repeat your answers.
    12. Organize your papers in a way that will allow you to retrieve them easily and quickly. Examiners appreciate order and someone who doesn't waste their time.
    13. When the interview is over, always ask for the results. "What should I now tell my wife about my visa status after our interview?" Before you leave, have them explain any papers they give to you and/or any procedures they will be taking to complete your case. Try to get the examiner's name for future reference, if needed. Write it down. Remember to verify the phone number so they can contact you to pick up the VISA.!@! hurray@@!!!
    14. Arrive early to the consulate, but always be prepared to wait for a time past your scheduled interview appointment time. Be careful of thieves around the consulate if you have to carry cash. Bring ID; you cannot enter without it.
CONFIDENCE IS THE KEY TO ANYTHING!

bernice_lii reacted to OCCmarine in Will my recent deportation from China prevent me from bringing my Chinese fiance to the US?
I think it would depend on why you were deported from China. If it was for a significant criminal offense, then yes USCIS and the State Dept. would thoroughly investigate and may deny the petition. If it was for something minor like a visa overstay, then I wouldn't worry too much. The important thing is to be honest and not try to hide anything. If you don't mention the deportation it could be a reason for denial even if it was over something minor. Stuff like this is very case by case and really depends on why the deportation occurred. I hope this gives some insight into your issue.

I am a Jan 14, 2013 filer. my case was sent to the National Benefits center with a MSC #.
some time in March I called and was forwarded to a Tier 2 officer who notified me that my file had been transfered back in Feb of 2013 to a my local Tampa Office.
I received an NOA2 on June 6, 2013 and i never was able to look up my case status until I called and found out I had been approved. I went to the site and tried the number and it FINALLY showed up online.
so I think you might one of the few that never can pull up their case status online until its approved. hope this helps.

Time to stand up for yourself, remove yourself from the bad situation.
If your family doesn't support/understand you, find someone like your close friends, schoolmates to lean on.

And they don't actually ask for pictures.... have you seem eachother in the last 2 years?
Basically, you guys did not do your initial packet correctly, and you get a RFE for missing things, and your reply was not correct either. It would be a good idea to figure out exactly what went wrong so you can be successful next time.

Post Decision ActivityOn June 7, 2013, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice.

This is the FIRST time I am able to pull anything up by using my case number. Our time has finally arrived. NOA2 to be sent in the mail. Now I have to read up on the NVC process, doing this on my own just like most everyone on this forum. Very grateful for all the help and tips. No RFEs!!!!!!

    I hope you are next!!!!

It depends completely on the individual circumstances of the case. Your case will be subject to increased scrutiny, and the indending immigrant to extra questioning, but there is not an automatic denial.

Read the guides and get to work. Collect the documents you need and get started. I don't know if there is DCF there or not but I would suggest going to the forums that are region-specific so you can ask others who are in Hong Kong how they have faired.

Unless there is a serious change in your ability to prove beyond a doubt that you MUST return there is no point in applying again. However you can apply as many times as you want.
My advice is for you to accept reality about getting a tourist visa. The strongest ties rule must be understood and the criteria met to be granted a tourist visa. You cant meet that criteria. Letters from a fiancé and his mother could cause someone to question your return for example.
Keep in mind that every person with a visa is considered an intending immigrant.

bernice_lii reacted to LilyR in CR1 Petitioner interview before NOA2?
It is not all that unusual for the US citizen to be called in for a "standard interview" during the process of adjudicating the 130. One of the most common reasons for being called in for a standard interview is if the spouse was in removal proceedings when the wedding took place, but there are many other possible causes. I also received a notice for a standard interview in the middle of our 130 process. (NOA1 - 12/21/2012; notice for interview received 3/20/2013; Interview 4/23/2013). I did some reading both here on visa journey and on immigrate2us and the good news seemed to be that for most people the interview was brief and easy and an approval was given within a day. My lawyer was very concerned for our interview, but it went very smoothly and easily. The officer asked me a few factual questions to start (my name, birthdate, parents name, husband's name, birthdate, parents names) then asked how we met, asked if the families all knew about our marriage, asked how my children felt about everything and that was it. I got a text message about 4 hours later with the approval and got the actual letter 2 days later in the mail.
