    the report is missing some key elements....like those who have the ever popular mind change at baggage claim, whether to get married to the porter or to attend classes at some No-Nam-o 'university or to join an ESL program....sorry, but anyone who can, ten minutes after arriving in the US, alter their lives so dramatically, had to have been an intending immigrant....that is why I firmly believe, as so many of you know, that Congress should, without costing us taxpayers a penny, end all AOS/COS from B2, F1, H3, J1 visas. Otherwise, these visas just are devices to be used and abused to avoid scrutiny and to get one of these visas by saying one thing, but doing another. Yea yea...we keep hearing about how people should be allowed to change their mind...fine....but end the possibility of changing their status! If they really want some other visa or status, go back home and apply for it there. you still get to change your mind, but now you will have to further demonstrate your bona fides.

    How long have you been separated? While there are cases which take over a year for AOS, I wonder if there is a chance your greencard arrived some time ago, and your wife kept it. What does your online status say?

    Another HUGE thing to remember, if you don't make arrangements with the DHHS of the county the support agreement is out of, your ex can go to court and request a judge to find you in contempt of a court order, which will have manditory jail time, unless you have an extremely good reason for not fulfilling your required obligation, and a verbal agreement between you and your ex does not exclude you from court ordered support payments.
    also, never trust your Ex, they are an Ex for a reason.
    FWIW, I was in the same boat with being in arrears with my support payments to the tune of 25k (long period in my life where a lot of bad stuff happened and I was unable to pay), but as soon as I stabilized myself I immediately contacted DHHS and started making additional payments to clear the amount, so that I could get my passport, and go to visit my fiance. For many months I dedicated every penny from my paycheck that wasn't required to feed myself or pay a manditory bill (Rent, Utilities, ect..) to paying off my past due child support. I was literally living off of $50 every 2 weeks as I drained my savings and each paycheck to make things right.

    I can understand why you don't want to officially live in the US. I assume your benefits would be stopped and you might have to work.

    I would be very very suprised if the VWP, was put on hold. Mainly because of all the financial implications involved.

    If she doesn't show her friends on FB that she is married, and crops you out of photos (actively makes an effort to conceal your existence) then I would give her the boot. Put her, and the iPhone, and whatever else it takes to get her moving, and put it all on a plane back to DR. It will be cheaper and less painful in the long run...

    Thanks you all for all your helpful responses. I have an update on my original inquiry:
    I checked with the benefits person at my company and my plan does not consider pregnancy a pre-existing condition and coverage begins the day that I elect the benefit upon getting married.
    As many have mentioned, we are also not required to have a SSN at the time we sign up for her coverage. The SSN is something that can be supplied after we have it.

    You are more than covered. all you need to start the process is proof that you have met within the last two years. And you already have that. It would not hurt to include his credit card statement if you used it for anything while there with you. I got a ticket for missing a payment at a toll booth while I was visiting, so I sent that in.

    True and because of my impatience I chose the extra hoops and fees so I can reside with my fiancé several months sooner than were he my husband. It was a calculated choice.

    Your I130 approved in 40 days mine still not approved since December 2014, many peoples are like me who are waiting for their NO2 and you are crying over your NVC process sounds funny to me.

    i moved to the states 2 months ago and i can relate to the cultural shock thing but i would never disrespect my husband like that, there are mature ways to express yourself and constantly yelling complaining and demanding just shows how immature a person is.

    You are mistaken. USCIS does not consider it abuse for someone to refuse to file petitions on behalf of an alien, by itself. If there are other patterns of behaviour (physical/mental abuse, etc.) then it can be shown to be a factor, but ipso facto it is not considered to be abuse.
    As for the OP, whom I suspect has departed due to his (rightful) castigation earlier in the thread... you criticise your wife for having a fallback plan and so your fallback plan in return is to engineer her deportation from the country? Honestly, this makes you sound like a monster, regardless of what has happened and continues to happen between the two of you.
    Anywho... as plenty of others have stated, your wife can file for RoC without you. Let's theoretically suppose that you are able to delay a divorce for a couple of years, but it's ultimately granted (because this isn't the Philippines and we don't keep people married against their will without divorce being an option). Your wife would be out of status from the time her green card expired, but would then be able to file a late RoC application on the basis of a divorce waiver after your divorce was final. RoC via a waiver of the joint filing requirement can be filed at any point up to the alien's removal from the US, even after their green card has expired (I-751 instructions, page 1). Provided she could demonstrate a good faith marriage then she would likely not have an issue obtaining her unconditional ten year green card.
