MedRoni reacted to Harpa Timsah in We're both in tears over this. Please help. I can't be without her.
Just like you need a visa to live in Canada, your wife will need to obtain a visa to be able to live in the US. Filing a I-130 does NOT allow her to live in the US; I think that is getting lost here. The I-130 needs to be approved and she needs to go to Canada for an interview for an immigrant visa. The I-130 is just the first step and does not grant her any special anything by itself. She can visit in the US in the meantime, but her being married to you does not allow her to live in the US by itself.
If you go in a truck with your household belongings to the border and she does not have an immigrant visa, then yes, she will probably be denied entry.
There is no way to get your wife an immigrant visa without being separated for a while, unless you delay your moving back to the US for a year. Seeing as you already quit your job, I guess you are not putting it off for that long.

Koscher is acceptable for Muslim's to eat as well and can sometimes be easier to find.

It is highly likely that you will have some explaining to do.

MedRoni reacted to PalestineMyHeart in Anyone had a home visit by Homeland security?
"Victorious sect" is a reference to at least several Hadith. I wish Sofiyya was here to explain it more completely and professionally. But to the best of my knowledge, it basically says that Muslims should stick to their faith and obey the requirements of their religion until Judgment Day, no matter who tries to fight them, because they will be victorious in the end. It long predates any groups who have may have hijacked the phrase to try to give their unGodly behaviors some kind of religious justification.

Sounds great!
Make sure to "offer" some of this up front when you file the petition. They don't always let you show it at the interview. It is nice to get it in their hands before then, especially in tough embassies

If your petition expired and this happened, I can't see it as a good sign. It has never happened to me so I can't really say, however I would gather as much proof and information you can about your relationship as well as maybe anything you may have showing Muslim activities - maybe pictures from the past few years of a group gathering/event with the local mosque you attend, etc.
That way when you re-apply you may be helping calm the issues they had this time around. I am sure your home visit will be noted in your file, so you will need to help clear up anything you can with the next petition.
Best of luck to you!!

MedRoni reacted to Boggy1974 in I 129f appeal
That would mean you did not send in a timely response to the RFE. Wondering how an appeal would be won if you failed to respond timely to the RFE.
File a new petition - now you knowing your mistakes and including all required documents to get an one-shot approval. GL!

I am struck by your online name here, 'victorioussect'! Should anyone be concerned about your choice of a name? Does it imply anything that should concern homeland security?

Do you or your wife work? What's the income? If not your last hope is that who ever is in the U.S. gets a job that satisfies the limit on the I-864 instructions.

How about planning the wedding for summer 2014? Have a quick legal/ court wedding whenever she gets here, then do the ceremony and reception next year.

Don't set a wedding date until you are approved. We did prepatory work like choosing wedding them, buying wedding dress etc. But we didn't set the date until she was approved.

MedRoni reacted to Hypnos in Administrative Processing? Go to your local Congress!
Members of Congress have no involvement in how long or short AP will be for any particular individual. You happened to get out of AP around the same time as your congressman enquired; this was a coincidence.

MedRoni reacted to Penguin_ie in What's next? Expedite interview for I-130
It happens more and more often now cases are being processed by NBC that the petitioner is called for interview, so this is nothing to worry about in itself. Yes, bring your evidence, both bonafide and expedite (ie letters from doctor). They will talk to you some about how you met him and your relationship. Also if there are any red flags (huge age difference, him having been petitioned before, you recently divorced etc) they will talk about that too.
While this interview for you is noting to worry about, I'm afraid I do not think he'll be in the USA for the birth of your child; it would be very difficult, even with an expedite, to get through NVC, get the medical done and interview scheduled, then the passport back within a month.

Also want to let people know that 2012 transcripts are available as long as your taxes got accepted already, so if you did your taxes in early February or before that then you can get your 2012 transcript already.

MedRoni reacted to Saylin in Proof of income and domicile
In your case, you might want to consider moving to the US sometime soon. Get yourself re-established, find a job, etc, and then continue on with the AOS process. Because, right now, you don't have any income that will continue after you move, and if you don't have any proof of US domicile, then you're not going to pass through NVC and the AOS step.

MedRoni reacted to Grant PDX in Need PHI Lawyer advice on ex boyfriend and families right to take a child
OP, I would be careful here about making assumptions. There are some things that seem very clear in filipino law, but some don't seem clear at all. Normally a mother in this case would have sole right to the children. But if I recall from your previous posts the oldest child has spend significant time in the care of the paternal grandmother. The fact that the child is over 7 and has spent significant time in the father's care (could be just the grandmother, but in court I would expect it to be presented that it's time in the care of the father), I don't think this will be cut a dried. I would get a good local attorney. Although some will say the mother has all the rights, which is normally true, I don't think this case will be as cut and dried.
Another thing, your story presents the father as a horrible human being. This is, I am certain, only coming from one side: your fiancee's. He has done some bad things. At the same time he or his family are taking care of his child, he has gotten his nursing degree, and he's secured a Canadian visa allowing him to go there to work. Put these together and it looks like he's been studying and working hard to secure the future of his family. I'm not saying this to say he's a great person, but there is a whole other story here that I'm sure you're not seeing, but will certainly be presented if this goes to court. If his family has contacts that ease his ability to get the judgement that he wants, there is a fair amount of risk for your fiancee. Given the "other side of the story" they may very well be able to present your fiancee as the "bad" person and the ex-boyfriend as the one who has been working for years to provide for the future of his family. Again, I'm not supporting him, just trying to give the alternative view that may work against your fiancee in any future custody battle.
Sorry you find yourself in this situation, but you may be in for a difficult battle in the future. IMHO, your fiancee must get a good local attorney ASAP and get this moving.

MedRoni got a reaction from Nicole Johns in Case not at NVC Yet
Ours did not say that, no. It said it was being sent to the NVC.
What does the status update on their website say? Which packet did you actually send in? Was it only the I-130 or did you include something else?
