    Collecting evidence for those who already have it is the easiest part, something a couple can do while waiting for their marriage certificate (since we got married in Maui, we had to wait 6 weeks for our marriage certificate anyway). Of course, for those that have nothing to show, then that's it, nothing to be done. My advice was: IF you have it, send it. It doesn't hurt your application and it doesn't cause delays if you plan things properly.

    Last night what I thought was an online interview for a job that I had applied for -turned out to be a potential defrauding scam. I am making this post to share my experience so that people who are desperate to get a job may not fall for this or any other similar trap.
    This is how it began:
    A few days back I had made a job application for the following position

    Once I clicked on the APPLY button I was led to this following website:

    After making the job application I had received the following email response:
    Dear Applicant,
    Our recruitment team viewed your resume Application : Data Entry - Full Time/ Part Time) and we are pleased with your qualifications,we believe you have the required qualifications to undergo an online interview.you are required to setup a yahoo mail account (mail.yahoo.com) and a yahoo instant messenger(messenger.yahoo.com)after this process is done,you are to add up Mr Mike Anderson on His yahoo ID (Hroffice900@yahoo.com) to your yahoo buddy list and Instant Messenger him for the interview Asap for the interview so that you can get Started for the position.Interview schedule: ASAP

    Although I felt it was slightly unusual for a job interview to be conducted through yahoo messenger- I had known of friends being interviewed via Skype so I did not pay much attention to this detail.
    Last night this is how the interview proceeded in the yahoo messenger. I have edited some parts where not relevant and I have some sentences in bold and italics where the scam can be detected. Sentences beginning with "hroffice900" is the guy who was interviewing me and replies beginning with "r" is me.

    Then after you have deposit it into your account then you are to cash it out and you are to purchase this softwares from the shipping agent who we have been buying from for years now....and means of payment accepted by the vendor is via western union which i will be providing you with the vendors information which you will be using in purchasing the softwares and other needed working materials.
    AT THIS POINT I HAD SUSPECTED OF SOME FOUL PLAY AND THUS MY FOLLOWING QUESTION

    Posters can read from the above that --Mr. Mike is going to send me a cashier's check for $2,250 which I am supposed to deposit in my bank account---cash it-- and then send $2,250 through Western Union to a vendor to purchase the software. We can see here how the scam is going to operate. Once I cash the cashier's check--I will be sending $2,250 in cash through Western Union. In due course the bank will inform me that the cashier's check was a counterfeit and I would have to pay back the money to the bank. In the meanwhile this vendor would disappear into thin air after receiving $2,250.
    I had made a complaint to the local police and also to the FBI since these guys are making job advertisements all over the US. My fear is that there are- at this very point in time- some people who might be in the process of being defrauded or worse some of them may have already been defrauded.
    It is very cruel for these unscrupulous characters to be taking advantage of people who are in desperate need for a job.
    Anyway my post is intended to share my experience and thus for people to be aware of these scams.

    I might regret posting this, but I know someone who was a CO at Lagos (and at other consulates too, high fraud and lower fraud), and since I considered going that career route, I had lunch with her, discussing what it's like to be a CO.
    She confirms Lagos is the worst in terms of scammers, and denials.
    But relevant to VJ people, YES, please front load, especially K-1's, as the odds are not in your favor for K-1's.

    So you are telling people to just "Meet requirements". Yet the I-130 instructions clearly say.
    What Documents Do You Need to Prove Family Relationship? NOTE: In addition to the required documentation listed above, you should submit one or more of the following types of documentation that may evidence the bona fides of your marriage; Documentation showing joint ownership or property; or A lease showing joint tenancy of a common residence; or Documentation showing co-mingling of financial resources; or Birth certificate(s) of child(ren) born to you, the petitioner, and your spouse together; or
    Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship. (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage); or Any other relevant documentation to establish that there is an ongoing marital union I bolded the last because this is left up to you to show what you deem to show. As we know the government is slow to update or change. The I-130 form as far as the co-mingling you see is directed more towards couples who live together (ie. before they immigrated or when they are going through removal of conditions). It wasn't targetd towards the new age.
    Cuz Wham the internet revolution happened and now we have emails, and chats, and IM's and Skype a whole new world of evidence and fakery.
    I don't know where people get you aren't suppose to send anything when that's what USCIS accepts. Sure I know a few Lagos folk who sent NOTHING but a marriage certificate and of course lazy USCIS approved them send them on their way but guess when interview time came they were ALL denied. Sent back reaffirm all but a couple (other issues they had) but still a lost of an additional year.
    I know thats not what you want to hear you want sunshine and unicorns. Well This is Lagos. By the way they all prayed and know God.
    I believe OP you got plenty of good advice by the best VJ has to offer. Take it with what you want. We await your review June 11th.

    You been chasing needlessly. Focus on getting your case#. Read the NVC process Wiki in my signature please. Call NVC and keep calling until they assign the case#. Sorry you been wasting your time. Forget USCIS.

    No it will not be the embassy that will schedule the interview. NVC does according to the slots given them by the embassy. All IR1/CR1 interviews are scheduled by NVC.
    OP, NVC will send you the Interview letter when that time comes. Hopefully you are high up in the queue this time around and get June interview. Late this coming week or next maybe you will hear something.

    Sorry that you learned of your husband's true colors late. Be thankful that it isn't too late and that you are alive, well and are able to move on from this. I don't think situations like these are specific to Nigerian men. There are violent and malevolent people out there no matter where they come from. Immigration issues force some of us to hurry and take leaps before truly getting to know the people we're committing with and most do end up with buyer's remorse. It doesn't always turn out like that though. There are quite a lot of us that also end up with happy endings. You just can't know and that is always the risk with life amongst all things.

    If it says issued its ready for pick up. Have you called the VI to see if its ready? The embassy really doesn't call back at Lagos sometimes yes but not all the time.

    No don't worry your case will be fine and you will be approved. Our case was different then the average case my husband had a child born after our marriage and even though I had accepted the child and forgiven my husband the CO would not even accept the evidence of that. My husband went in and was completely honest about everything and I am very proud of him. I am trying to email the the Embassy now and submit our documents to them to get them to change but if they don't we will go thru with the process I will be at my husbands next interview and I will be spending some time in Nigeria so they will not be able to turn him down again. So please do not worry about your own case have faith you will be fine.

    Hard to believe it has already been a year, October 12, that my husband arrived here in the US. Seems like just yesterday we were waiting anxiously for him to set foot off that plane. Seems like just yesterday we sent in the I-130 and waited for NOA2. Seems like just yesterday we waited for case complete and to hear of an interview date. Seems like just yesterday I attended the interview with my husband and heard those dreaded words "we are sorry your case in is mandatory administrative processing". Seems like just yesterday I received the email from the embassy that said "The administrative processing on your husband’s visa is done and approved. Please send us his passport to go ahead with processing the visa.". Seems like just yesterday he walked off that plane....
    It has been a wonderful, exciting, and at times stressful journey. Filled with laughter, tears, joy and anticipation. It has been simply been amazing.
    This is us at the local diner, The Red Arrow, our favorite spot.

    The NVC will never send you a mail via aol, gmail or yahoo, if the mail is from NVC the domain will be xxxxx@state.gov. I see a red flag on fraud here. If you have ever received email from NVC, you can compare the addresses.
    Also, to what bank were you asked to pay into? If you are in Nigeria, the embassy has only one GTbank account.

    People told me too that my additional information would not be matched up with what I originally set in. I made the stupid mistake of only sending in just application and paperwork, but then realized i was suppose to said in evidence too like 2-3 months after they had our app. but I sent it anyway, and it was also matched up. I didn't go overboard though. Just provided a variety of everything that would "paint" our picture.

    It really isn't about your age difference but you showing a bonafide relationship.
    You said you visited 3 times. Over how long a period? You meet how long ago? Your 3 visits were how long in duration? You meet his family and friends and have their support and Blessing? Honestly your chances are so much greater for a possible approval if you marry like mentioned above. No not a guarantee but it shows you are committed towards each other. Sometimes with much older younger a K1 couple shows the CO that they aren't sure (may not be the case but heck why not marry).
    Great you love each other and all that but the CO at embassy doesn't know you. If I was a CO and a 40 years older woman's profile showed up on my desk with engaged I would wonder why the hold up why not just get married. Especially if you have known each other over sometime.

    All thanks and Glory to God, my K1 visa interview in Lagos went smoothly got my visa approved, in my own opinion i would say the interview is the easiest of the whole process almost as if i was claiming a benefit or something, in less than two minutes i was approved.
    so here are the interesting questions i was asked...
    1. who petitioned for you?
    2.whats your fiance's name?
    3 where does he live?
    4. what does he do?
    5. whats the name of his company?
    6. has he met your family?
    7. when last did he visit?
    8. how long have you known him?
    9. have u met his parents?
    10. how many sibblings has he got and what, where they are?
    11. what does his parents do?
    12. why not have the wedding in Nigeria?
    13. how did he proposed?
    14. brought a pix from what we submitted to USCIS and asked to confirm if My fiance was who was in the pix.
    15. lastly and oddly, have u travelled out of nigeria before and the purpose of your travel? and then he said Congratulations!
    ... just keep your answers. direct and straight to the point, be confident, stay composed & eye contact cos they did look me in the eye.
    Have faith The Visa is yours !!! All da best!

    Personally in my evidence submitted I would write up a relationship timeline and plug in those dates you just mentioned when wife filed, when you separated when you meet new wife, decided to have relationship, the visits, when you filed for your visas. This will help pull out all those mountain of pages the facts.
    Here is an example of a timeline.

    RELATIONSHIP TIMELINE

    Minnie Mouse– Petitioner Mickey Mouse - Beneficiary
    May, 2008 – Meet (put in names here) on the telephone via an introduction by my close friend, Goofy, August, 2008 – Started e-mailing, chatting on Yahoo Messenger and talking on the telephone. November, 2008 – Relationship progressing to a serious level. Made trip #1 to Osaka, Japan. Met his family and friends. January, 2009 – Mickey proposed marriage over the phone. I accepted. We are officially engaged! February, 2009 – I file an I-129F fiancé petition for Mickey in the U.S. on a K1 Visa. I have kids from my first marriage and we thought it would be considerate to have them meet Mickey prior to marriage and be present at their mother’s wedding, therefore, petitioning for the K1 and not the K3 or CR-1. February, 2009 – Trip #2 to Osaka, Japan. Our engagement party! May 2009 – I-129F petition approved by the USCIS. July 2009 – Mickey’s interview at the U.S. Consulate in Osaka, Japan. Request made by CO for more photos and e-mails. August, 2009 – 2nd interview at the U.S. Consulate in Osaka, Japan. Present many more e-mails phone records and photos documenting our relationship. Mickey’s visa application placed in Administrative Processing status. September, 2009 – Trip #3 to Osaka, Japan. Sweet reunion. November, 2009 – Request assistance from my Congresswoman – Carolyn McCarthy - to make inquiries on my behalf to the U.S. Consulate in Osaka, Japan regarding Mickey’s lengthy AP. December, 2009 – Case remains under Administrative Processing status. January, 2010 – I make a request of the U.S. Consulate in Osaka, Japan to meet with the investigator handling our case in hopes of expediting the lengthy AP period. Request granted. February 8, 2010 – Fraud investigators from the U.S. Consulate in Osaka, Japan pay a visit to Mickey’s parents house. His parents confirm that our relationship is genuine and that they support it. February 16, 2010 – Trip #4 to Osaka, Japan. Meet with fraud investigators at U.S. Consulate in Osaka, Japan. We are both interviewed separately and asked many questions pertaining to the details of our relationship. We believe all went well. March 2, 2010 – Mickey called to return to the U.S. Consulate in Osaka, Japan on March 23rd (after almost 8 months of Administrative Processing). March 23, 2010 – Mickey’s visa application is denied. Reason for denial: Investigator did not believe I was committed to marrying Mickey within 90 days of his arrival in the States on the K1 visa. Why? Because at the Feb. 16th interview with the investigator, I stated that I filed a fiancé petition instead of a marriage petition so that my kids could meet him first before we get married and be in attendance at our wedding. Investigator interpreted my words to mean that I needed to “understudy” my fiancé and that I wasn’t sure about marrying my fiancé. April, 2010 – Attempt to overturn denial while case still at the Consulate: Letter sent from my attorney – Marc Ellis – to the U.S. Consulate in Osaka, Japan along with affidavits from friends and family attesting to the fact that my intention was always to marry Mickey as soon as he arrived here on the K1. Attorney letter and affidavits never acknowledged by Consulate. April/May, 2010 – Plan our wedding. May 29, 2010 – Trip #5 to Osaka, Japan. June 1, 2010 - Get married!!!!! June, 2010 – Upon my return to the U.S., file an I-130 petition for my husband to come join me in the U.S. on a CR-1 visa.     This was a very sad read for me.
    There is more to life than this and you deserve to be happy.
    I don't have an answer or guidance but will only ask that you seek to not loose your self and to find happiness.
    Life is really too short.
