I love your response and I very much appreciate you sharing that with me. People tend to give generic answers and although they are helpful sometimes, its good to know there is someone out there that has been through it or is closely familiar with it. I will be armed and ready with tons of evidence, I'm just hoping they take the time to look at it. I am nervous...and I'm not surprised that I am since I tend to be very pessimistic....lol..... but I really feel we have an 80% chance on this. And as you said...it's truly unfair to put a price or timeline on love ......
    thanks again

If this were me, I'd be on the phone right now with every one of my credit-card issuers (they have 24-hour lines for "lost or stolen cards" via which you can talk to a human being). Explain the situation; tell them not to authorize ANY out-of-town or out-of-pattern (meaning your usual purchasing pattern) charges, and certainly no cash advances. No card-issuer is to process any change of address for any account unless they speak with you personally. Start with the Visa, MasterCard, AmEx, & Discover, and proceed through the gasoline-company cards. It's NOT necessary to cancel every card that you have; just put fraud alerts on your accounts.
My next call would be to ICE. Even though her I-94 (not "visa," as was stated above in an otherwise excellent post) won't expire for 90 days since her POE, you want to start a file NOW so that ICE and USCIS can be aware. If the ICE agent with whom you speak is reluctant to start a file now because the 90 days isn't up, politely ask for a supervisor -- and persist until you're connected to one. Your goal is to have this entered into the system even if no action can be taken yet. Get a case-file number and the names and locations of each ICE agent with whom you speak. When you call, have her A# ready, and her Colombian passport number if you can find it.
On Saturday morning, expend any price to have a locksmith rekey ALL of your locks as top priority. If she had a mailbox key or the chance to copy yours, consider having your mail held at the Post Office for you to pick up, for a while at least. This would keep your credit-card statements and bank statements safe from outside hands.
Follow all of the advice from others. At all costs, do NOT (do NOT! do NOT!) allow yourself to be sweet-talked or suckered.
Before I met Mrs. T-B., I was nearly suckered by a very clever Colombiana. Wiser friends told me that although there are many sincere Colombianas, there's also an incredible amount of fraud, at a very sophisticated level of operation. I'm glad that I listened to the warnings.
As shocking and painful as this is, you've gotten off very cheaply (in comparison to worst-case) and unharmed so far, presuming that you act per above. Thank your lucky stars for that, si man.
When you've healed from this, I can get you fixed up with 100% sincere Ecuatorianas who would never sucker you like this, no man.
    Keep the faith, si man.

yes, like someone said it is how you make of it. What are your qualifcations? (rethoric question), how big is your social appetite, how low are you willing to start from. It is not how for but how well! I came in here 5years ago on an employment visa and yes I am aware U.K. and Nigeria are not the same but still this country gave me unbelieveable opportunites. I make a good amnt of money( I have just ONE job), I have a BRAND NEW CAR that is completely paid for (within 2.5years of purchase).I earned my bachelors last year and am in the process of acquiring two masters degree from two schools now.
I dnt go buying clothes, latest gadgets etc just to show off. My credit is EXCELLENT. I live within my means. Occasionally if I have a project, I do extra shifts to meet up the needs for that and then I revert to my regular hours.
You have options so I would say give it 5years ( 3years since you are marrying a USC right?) and after you get ur citizenship, you move back to U.K if you still dont like it.

The strange thing is that you married the American culture that you don't like! Ironic...
I don’t live to work nor do my friends! We have personal lives! It's how you make of it!

The consulate is not required to consider a sponsor other than the petitioner for a K1 visa. Even if they consider it, they have to be convinced that the cosponsor would actually provide support if it was needed. One way to take the discretion out of the hands of the consulate is to get married and be petitioned as spouse. For the spousal petition, the law specifies who can be a sponsor/joint sponsor and specifies specific income requirements and is not at the discretion of the consulate. In fact, the matter of support is settled even before the petition leaves the U.S. For the CR1/IR1 visa, the consulate has no role in considering validity/viability of sponsorship.

They did not mess up. You did. The instructions tell you what documents are needed to file along with the I-129F. You failed to read and follow the form instructions. USCIS is not required to send you an RFE. You were missing everything, not just 1 or 2 things that would lead them to send an RFE before approving your petition. I have seen others outright denied for not sending in anything but the form and the fee. This is nothing new. They took the fee, processed your petition and denied you for having zero documents and evidence.
Don't bother with the motion to reopen. You cannot reopen the case and win. You were correctly denied. It will cost you more money and time to go through all that. You need to file a new petition, making sure to read the form instructions that you can download directly from the USCIS website where you download all the current forms. Read the guides here as well. This will inform you of everything needed to send with the petition and there are even sample forms and letters here to help you. You will have to pay again and wait your turn in line again. There is no way around this.

You probably didn't get any RFEs because everything was missing. It's one thing for them to send you an RFE for a missing copy of a birth certificate, it's an entirely different matter for them to tell you "dude, everything is missing, resubmit".
OP, frankly, if you missed that you needed a whole bunch of supporting documents, I suspect you would best be served by hiring a professional to do this for you. Everyone can miss a particular nuance or individual item, but if you're not able to read the instructions and even come close to what they are asking for, I don't think you're going to be successful trying again.
If that's too harsh for some people, too bad. Do you want delicate half truths that don't hurt your feelings, or do you want sound advice? My advice, hire a good lawyer.

You are still " messing up". You forgot to include the info people would need to offer advise. Like what you forgot to send in.
You called & were told how much the motion would cost but want a different answer? Its is correct.
Do we know what we are talking about? The real question is do you? There has to be more to this than you have said.
Its unlikely you would be granted a tourist visa after someone files an immigration petition for you. You will be asked about this if you apply. Study the strongest ties rule prior to attempting a tourist visa. Make sure you know what you are talking about.

Hey everybody, this is just a followup from a post that I posted in October. My fiance had tried drugs in the past and the embassy is aware of that after having medical records sent. We were worried that he wouldn't get his visa because of this, BUT he had his interview today and he just called me to tell me that he got approved for the visa and should be in the mail soon! Apparently they didn't even ask him about it. Barely asked him any questions. He said overall it was super fast, easy, and stress free. Just wanted to let you all know!
WE GOT THE VISA!!!!!!!!! :) :) So happy!

I just don't understand why all these guys think they can tell a woman that they will take their kids away but is harder for me to understand why the wifes believe it. See a lawyer, at least you will support only 4 persons not 7. Why didn't he talk to his daughter and convince her to find a job to help you with all the expenses, or does she takes care of the 4 kids while you are working?

2.IS it right for my husband to let his daughter lives with us and use me?And he is not even making any income for 2.6 years now? NOPE. It's his daughter and she's already an adult. She shouldn'teven be there
3.WHat is the legal way(if there is any) that i need to do to get my step daughter out of my house? They said in the state of GA you can not evict someone who lives with u for over 30 days and she live with us since 2009 till this very minute.hmmm?? can't you call 911? I'd love to do it.
    4. SHould i just let my step daughter ruin my marriage? My hubby said he wont allow his daughter and grand son live on a street which i really do understand.( His daughter's own mom won't even deal with her because of the way she is). Maybe the reason why his daughter is irresponsible is because he's is enabling it.
5.But what about me? this all causes me too much stress that is more than enough and too much for me to handle. Because it looks like they can just manipulate you. If they see you're serious, they'll do something about it.
6,When hubby and daughter argue he tells his daughter to get out but i knew he never really meant it?
It's not him who's working so he doesn't exactly feel what you feel.
I know you have tried to talk seriously with them, try once more but you should do what you want need to do. Consult a lawyer. Call 911.

I guess we are going to agree to disagree.. All I know is I been tracking my NOA1 and each day through the site. I can see updates being made with EAC numbers lower then mine. I will be glad to get back to you in 7-10 days, because that is when I figure my NOA1 will be approved.
It is just a process of helping couples get through the stress of the NOA1 to NOA2. It is not a solve all answer.

I agree totally with you... during our process and currently our AP the only ones who know and understand and can offer the best advice are those that have either gone thru AP or the process in Islamabad... its a totally different criteria than most other countries. The one thing I realized is when i offered my assets of over 108k I was told it wouldnt' be an issue ( i was over the poverty line by almost 1k but still thought it best to show assets) ISL didn't want to consider the assets because that is the way that embassy works... fortunately i hired an attorney right after the interview to address that issue and another one and was able to overcome that issue. The only ones that would have known and given me advice to get a letter from the attorney PRIOR to interview would have been those going thru ISL... if we had done that we would have shaved off about 6 weeks of review before the security checks started and would have been a month ahead in that part of our AP... but they didnt' begin the checks until AFTER they were satisfied which is understandable but still frustrating...
I still get good advice in general from those that are long time members but when dealing with something at this particular embassy and in detail i do find it best to post in the country specific area
