No current tax return for K-1 Interview. Problem?

Hi Everyone,

My fiance and her daughter will interview in Moscow soon. We have all necessary documents except my 2010 tax return (because my acountant usually files for an extension and has not yet sent it to me.) I have my 2007, 2008 and 2009 tax transcripts, and also have a cosponsor. Will not having my 2010 tax transcript at the Interview will be a problem?

yes you will need you 2010 tax because thats the recent tax return, you can always order one

I think you'll be fine.

You have the previous three years as a track record.

However.... October 15 (Extension deadline) is past.

Ha,ha... I can relate to your predicament, but I think you'll be ok.

If I were in your shoes, I believe though, that I'd GET 2010 DONE and in her hand for the interview.

jUST AS a matter of ASSURANCE.

12/05/2011...........RFE received.

12/13/2011...........RFE response sent.

12/16/2011...........RFE RESPONSE received by Vermont S.C.

12/22/2011...........Teased by a text-message from uscis, saying they have received my response to the RFE.

12/30/2011...........LA VISA APROVADOOOOOOOOO!!!!!!!!!!!

01/12/2012...........Case Sent To Bogota Colombia, from the National Visa Center.

02/09/2012...........Schedule Interview.

03/23/2012...........Interview (to take place then)!

04/07/2012...........Arrived in USA.

07/01/2012...........MARRIED!

What next?

Since I'm getting a Federal Tax Refund this year my accountant either waited until the October extension deadline to file it, or if it's legal for him to file it past that date because I'm due a refund then he is probably still sitting on it!

I'm in Russia now and can't do anything about it now other than email him and hope that he emails a copy to me soon. I ordered the (free!) Federal Tax Transcripts for 2007, 2008 and 2009--2010 was not available when I ordered them last month.

I wish I knew if not having a 2010 Federal Tax Transcript at the Interview is absolutely disqualifying--or of having a Co-sponsor will negate this problem.

And if it is a problem what then? Would the Moscow Consulate be satisfied with receiving an emailed tax transcript later, or would they require another full-blown in-person Interview?

Thanks to everyone who has commmented. VISAJourney is a wonderful Community and without you guys this would be a lonely and more difficult process!

I would get a letter from your employer stating your salary and how much you earned last year if possible. Then a letter from your accountant for why your 2010 taxes haven't been filed. Problem solved.

Also, I highly doubt they would deny you outright for not having your 2010 tax return. If anything they would just defer your visa's approval until you provided it.

Have a salary letter for a small, part time job--but most of my income is from rental property. Have copies of leases and rental payments into my bank acount. Hoping my accountant will reply soon, but can't count on it.

I don't know as a fact, but it seems to me that if you have a co-sponor that it will not matter that you don't have 2010, or any other year for that matter, as financial qualifications will be determined by your co-sponsors financial status.

David. I read the posts. You are highly unprepared for the interview. The best advice I seen was get a new Accountant. So, you have tax papers for 2007, 2008, 2009. No 2010 and 2011 is almost here. then currant income for 2012 maybe an issue. I hope your co-sponsor does not have the same accountant. I would reccomend getting something and solid proof of your co-sponsor's income. If you don't act now you will face denial or hopefuly a 221-g. The odds are against you but I seen it work before. I only write this because the information by members was a Guess game. YOU NEED TAX RETURNS WITH OR WITHOUT A SPONSOR

Exactly. I trust that you previously had talked to him about your visa petition and the need for the tax transcripts; I smart accountant would have filed sooner, just this one year, because of the importance related to it.

Having said that, if you've got all your other financials in order, then you should be fine. Moscow took all my stuff from my wife but we don't think they even looked at it.

thanks...2011 is not due until 2012 April 15, or 2012 October 15 with an extension. Unfortunatley, I cannot get a new accountant now. I do have a solid Co-sponsor who has completed paperwork. I appreciate eveyone's conjecture, but hope to hear from someone who has a definitive answer to my two questions. Thanks again to everyone! :)
