Yes absolutely you should file I-131. You don't need to have any specific plans to leave the US in order to file. If you don't file it he could be stuck in the US for up to a year while waiting for the green card.

Nobody gets a green card based on their child being a US citizen, until the child is at least 21 years old.
Your friend just needs to follow the usual CR-1/IR-1 visa path. It won't be faster just because she has a US citizen baby.

You chose to be in a relationship with someone in a foreign country. I'm sorry but trying to say that your pain is an less intense or any less of a choice than a military family is not fair at all.
I liked our time on Skype, we annoyed each other a lot less than we do in person. Once your in person honeymoon phase wears off and you start to hit the real stumbling blocks (like we have in the 1.5 years of in person time) like infertility, multiple miscarriages, death of parents, family drama, home renovations, money issues, moving countries twice, etc. etc. Relationships are rough, cross cultural relationships comes with issues, and trust me this little separation is NOTHING compared to what you will face in the future.

You are misunderstanding the requirement. If you met on June 25 2013 then it means you can file the petition any time between June 26 1013 and June 25 2015.
Getting married comes later in the process. First you file the petition then wait for it to be approved. Once it is approved you can apply for the K-1 visa. Once the visa is approved you have 6 months to enter the US with the visa. Once you have entered, you have 90 days from your date of entry to get married.

Lainie B got a reaction from KayDeeCee in Married or Maiden name on I-864 for USC?
You don't need to get your name changed on your social security card before you send in your AOS. Social security doesn't do legal name changes, so no need to "file name change with SSN". It's done simply with the marriage certificate. The marriage certificate is the only name change document you will need. You can do everything else (SSN, passport, DL, bank accounts etc) with the marriage certificates, whenever is convenient, in any order you wish.
Even if only your maiden name appears on the marriage certificate (as is the case in most US states) you can still use the marriage certificate as the legal proof of name change, and you can use your husband's name as your legal name from the day you get married.

She can use her married name. It doesn't matter that her documents have her maiden name. The marriage certificate is the legal name change document that proves her married name

You don't "legally change your last name" at the social security office. You change it by getting married. It doesn't matter if the marriage certificate only has your maiden name. It is still the only legal proof of your name change that you need. Everything else is just updating various agencies of your new name. You can start using your new married name legally from the day you get married.
A photo ID with your maiden name + marriage certificate (even if it has only your maiden name on it) = proof of your new married name.

Sounds like you were approved. The green card usually takes about 9-10 days to arrive in the mail following the first approval notification.

Marriage certificate is a legal name change document in us regardless if it only has your maiden name or both maiden and married. For SSN, you probably wont be able to change your name until you get your EAD/AP card though, so that you'll have a legal immigration status in your new name they can go by. Not sure about DMV.

Depending on the state. For example in florida when filling licence there is only room for maiden name and then after marriage that licence becomes certificate thus only your maiden name is on the certificate. This does not stop marriage certificate to be official and legal proof of change of name. When you fill aos and want to take your husband name just fill forms in new name, go to the bank with your certificate and theyll change your name there, same with Ssn (if you applied in maiden name).

How is that enforce people who must go home workin out when ther are 12,000,000 illegals in the US?
Deportation is not easy or cost effective.
Furthermore, people in the US are afforded due process which means everyone who is caught will fight in immigration court. Where would you like the tax money to pay for increase deportation come from?
Why can't you go visit him?
Knowing that it will take a year for him to immigrate, why did you choose to get pregnant?
Sorry for your separation, but you simply planned poorly.
You can't blame the US for your fiancé not be able to hold his baby when you knew it would take a year for him to immigrate and you choose to get pregnant and for you choosin to return to the US rather than be with him.

Use your new married name if that's the name you are using for your married life.
Only put your maiden name where it asks for "other names used" or "name as it appears on I-94".

You can sue. However, you case will be tossed out of court.
What has USCIS done wrong? What laws has USCIS violated in handling your case?
You cannot win if the case is simply taking longer than you would like.
You made the choice to marry a foreign citizen. There is no absolute right for your foreign spouse to live in the US based on your marriage. The financial burdens are yours choices too.
There is a process for you to get your wife here. Immigration is not Burger King. You can't have it your way.

You need to take a breather. You filed last month and you are already up in arms about suing and getting a Super Pac together. You are over reacting by a lot.
