Hello, I would like to know a bit more about these eligibility requirements:

Eligibility Requirements

If you petition for a fiancé(e) visa, you must show that:

  • You (the petitioner) are a U.S. citizen.
  • You intend to marry within 90 days of your fiancé(e) entering the United States.
  • You and your fiancé(e) are both free to marry and any previous marriages must have been legally terminated by divorce, death, or annulment.
  • You met each other, in person, at least once within 2 years of filing your petition. There are two exceptions that require a waiver:
    1. If the requirement to meet would violate strict and long-established customs of your or your fiancé(e)’s foreign culture or social practice.
    2. If you prove that the requirement to meet would result in extreme hardship to you.

My question is about the underlined and bolded text. I met my now fiancee in person on June 25 2013 (I stayed there for two weeks until July 8). She is waiting for a co-sponsor to financially support us prior to us getting married. However, I want to know if I have to get married with in two years of meeting her in person (I am from Australia), or from when she files her petition (She is from the US).

I am not sure. But, from the actual wording of the K1 Visa, it says that it is within 2 years of her filing the petition and it is obvious that the filing of the petition will be AFTER we have already met in person. For example (the date is just a fictional guess), if she gets a co-sponsor in April 2014 and files her petition in May 2014, does that mean I have until 2016 to marry, or do I have to marry in 2015?

Just wondering.

No, you're required to have met at least once within the last two years. Not 2 years ago.

No. It just means 2 years of meeting within the date of the petition submission to qualify. So, if you don't meet again, you have until 2015 to submit the I-129f.

You will have to marry within 90 days of your US entry on the K1. No later.

On a k1 you have to marry within 90 days of entering the US. you have to have met within 2 years prior to,filing the petition. I suggest you read, re- read and study the guides at the top of the page.

You met in person on June 25, 2013. If you have no other meeting between then and filing the petition, then the petition has to be filed by June 25, 2015. You had to have met in person, face-to-face within the 2 years prior to the filing of the I-129F. You will provide proof of meeting with the petition. This requirement has nothing to do with the marriage date. For a K-1 visa, you must marry within 90 days of entering the US.

Also, the I-134 and financial information is not provided with the I-129F petition filing. That will be needed later for the actual K-1 visa interview.

I met my fiance this year 2013 and he sent my petition and wevwent approved in 5 months,

I dont understand how you say they have to wait until 2015.

Because I never said that. Re-read what I wrote. I said they had to file BY June 25, 2015, not wait until then. You must meet within the 2 years prior to filing, therefore they would not be able to file based on their meeting on June 25, 2013 anytime beyond June 25, 2015. Never did I state they had to wait until then. As a matter of fact I said, "You had to have met in person, face-to-face within the 2 years prior to the filing of the I-129F."

OP Jay-Kay is correct, just make sure you have submitted your 1-129F petition before June of 2015. After you have arrived in the U.S, you must get married within 90 days. Good Luck to you both!

You are misunderstanding the requirement. If you met on June 25 2013 then it means you can file the petition any time between June 26 1013 and June 25 2015.

Getting married comes later in the process. First you file the petition then wait for it to be approved. Once it is approved you can apply for the K-1 visa. Once the visa is approved you have 6 months to enter the US with the visa. Once you have entered, you have 90 days from your date of entry to get married.
