    The visa expired the day you entered the US. The I-94 is the one that's 90 days. Even if the I-94 is still valid, most states won't give an ID card on just that. They require the EAD or green card. Even if they did give you an ID card it would expire the day the I-94 expired. There's nothing you can do except wait until you have the EAD or green card. There is no such thing as a visa extension letter from USCIS.

    Go meet in Saipan and get married there. It's part of the US, so allows same-sex marriage, but no US visa is needed for Chinese tourists - there is a visa waiver.

    It's not "automatically" changed, she still needs to choose to change it. However the choice is made by simply starting to use the married last name on official documents and changing bank accounts, SSN etc. The marriage certificate is the "proof of name change document" that she'll need to prove why she is changing at those different places. The SSO likely will not change the SSC one until she has her EAD though. They need to verify the name against immigration and it's not registered there until the EAD is registered.

    wrong. it's a grey area if paid in an account in that country in their currency. many Canadians continue to do satellite work during aos. you can look it up on here for more threads. just be sure that us taxes are properly filed.

    Most K-1 applicants aren't required to do an AOS interview, they, like you have, receive their green card approval without an interview.

    The friend from work is wrong. You can apply for jobs, you just can't start work until you have the correct documentation in hand. Have a look at the I-9 form, specifically the list of acceptable documents you can provide to show your employer you are eligible to work. You will need to do this on your first day of work. When you first arrive on your K-1 and apply for a SSN without a green card, the card will have the "valid for work only with DHS authorization" wording on it. The EAD is the authorization you need. So the SS card with the "valid for work only with DHS authorization" alone does not allow you to work - you need the EAD (list A). Once you have the green card you have the choice - you can either provide the green card on its own as proof of ability to work (list A), or you can provide the SS card without the DHS wording on it (list C) PLUS a drivers license (List B).

    If you have a I-551 Green Card (whether it is a 2-year conditional Permanent Resident, or a 10-year Permanent Resident), you do not need a I-765 Employment Authorization Document (EAD). The Green Card supersedes the EAD.

    You work at the Pentagon yet you are talking about forging legal documents? Also, why are you complaining about the USCIS when they were completely within their rights to deny your I-765's as you had no basis to file them, and getting mad that you are being asked for documents (divorce decree/evidence of divorce) that everyone who goes the process needs to provide?
    I am curious to read this op-ed.

    1. You notify them by submitting the AOS/EAD/AP package in her married name.
    2. Submit AOS etc in her married name. Once she has the green card or EAD with her married name on it, she can go back to the SSA and apply for a new SS card with her arried name on it.

    Assuming you submitted your AOS in your married name, wait until you get either the EAD or GC with your married name on it, then go back to SSA and get your new SS card with your married name on it.

    She changes her name with USCIS by filing the AOS/EAD/AP using her married name. Only once she has received her EAD or GC in her married name will SSA issue her a card with her new name.

    You can go ahead and marry now, he stays and files for AOS. No fraud involved in making a decision to marry now instead of waiting, as long as he never lied about anything to enter/when entering.
