    Theoretically. Practically I would be interested of a single case where people were removed at the entry because they exchanged emails on their work in their home country while being on vacation in US within the CBP allowed tourist stay.

    She is basically using a tourist visa to live and work in the USA.

    This is not true. She did not work in the USA. She was working for her Mexican company while traveling. Not to mention CNP has zero knowledge about it and even if they check her laptop and see work done during her visit, they will not stop her just because of this.

    F1: yes they may stop her. I would wait for at least 6 months before coming. However, even now the chances are 50/50.

    It's very kind of you thinking about her safety, but I think this is all waste of time and money. 

    Last question on the point above: when will we realistically need her signatures on the IR 5 process? Petition? NVC? At the embassy? I will file petition and will take it as slow as possible.

    She does. Thank you. She has 10 year visa. The problem is that she doesn’t want to come. I just wanted to do it as an insurance for the future, when u4u is gone and all she has is 10 year visa. 

  7. My MIL lives in Ukraine and is a successful lawyer. My wife is us citizen (from April this year). Ukraine is at war, as you know, and situation may change to the worse any day. MIL doesn’t even want to talk about moving anywhere. She has 10 year US visa and came here for 2 months after the start of the war. She left after 2 months instead of allowed 6 months (stamp) because she was missing home and her practice. 
    I am still thinking of convincing my wife to file for GC as an insurance. Can someone who went through this share what are the technical minimal requirements for opening and maintaining GC for as long as possible:

    1. Day 0 - entry at POE

    2. Stay in us -how many weeks minimum? 
    3. Go back home - technically, what is the REAL time she can stay in Ukraine without coming for the maintenance visit? 
    I would truly appreciate if someone can explain, essentially, timeline-wise, if it is possible at all to have GC while visiting US? 
    of course, under the normal circumstances we would just file when and if she is ready to move. However, she may be forced to move fast. This is the only issue.

  8. You can try to apply. It doesn’t hurt, as long as there is no misrepresentation, which will bite you later. I can only give you my experience. I had cancer and I TRULY needed my wife here as I was temporarily disabled for 2 years. I applied for the expedite with all the documents from the hospital. Meaning, extensive description of the REAL condition which requires care, supported by MRI, and the whole array of various physician-generated documentation. Bulletproof. And it was denied. You can extrapolate. 

  9. There will be very long AP for any Russian citizens for obvious reasons, similar to the reasons why citizens of Muslim countries get long by APs. Currently, Russia uses these “students “ and “tourists “ to spy or push Russian propaganda. This is the matter of national security and there is nothing you can do. Frankly, I don’t blame them. I would do the same. The only entity you can blame for such delays is Russian government. 

  10. I did buy tickets before the interview. Usually, if it gets approved at the embassy it takes about a week to receive the passport with visa. The rational for buying tickets ahead of time is that expected risk-adjusted savings from advance purchase exceeds the expected risk-adjusted loss on having to pay change fee on non-refundable tickets. However, this is true for Ukraine, which is not high fraud country (they are visa-free with EU for a while) and AP is very rare. In case of Egypt you need to adjust for risks differently. Egypt citizens face more frequent denials and longer and frequent AP, which delay things. 

  11. The only option I see here is her moving to your country or both of you moving to a third country. This is not about freedom. You and your wife are free to do what you like. The problems COs usually have are with with something that is OUTSIDE of the cultural norms of beneficiary and/or petitioner. For example, if your and your spouse’s roots were from Norther Europe or Israel, it wouldn’t be completely outside of socially acceptable. Still outside but not outrageously outside. This, if you are from these countries, I would still argue. If you are from Middle East, North Africa, or India: definitely not. All about cultural norms.

    Unless these are his nieces/nephews that his sister and him decided to bring into US and the DNA test will reveal it. Happens in Lagos all the time.

    It brings more prosperity. These visa categories are frequently used by kids of rich folks from versions countries. Like Russia, for example.
