US Immigration from Philippines

Greetings good people,

As my Filipina fianc and I are filling out paperwork for the K-1 visa, the one section asks if she has a child, which she does. BUT, the BC has her parents names on the BC, (they thought my fianc was going to die) and will take a year to straighten out through through the VERY slow courts system in the Philippines. The question is; Do we still put it down as her having a child? Or wait until the BC is corrected to file separately. and not mention her at all on the K-1 visa. And if we do not mention her as having a child, will that cause a problem on later getting her here?

We have thought about just doing the adoption of her daughter from her folks.

Any ideas will help.

I asked this question some time back and the unanimous response was to do a wire transfer. However, there wasn't much info available on the detailed process (requirements, fees, etc). I'm sharing my experience here so that others can benefit.

Wire transfers from PHP to USD (BDO - Banco de Oro)

***Also known as telegraphic transfer

Requirements:

• Personal appearance at the Philippine branch of account
• Original green card and passport
• Flight booking showing return date to US
• US bank account info (full bank name, SWIFT code, bank address, bank account number)
• Important:
  • Names on PH and US bank accounts must match exactly.
  • Before initiating the process at your PH bank, reconfirm the wire transfer instructions with your US bank. For example, my US bank account is in Memphis TN, but the bank's headquarters is in a different city. The correct international wire transfer instructions contain the bank's HQ address, not my branch of account. My bank also changed its name. The correct wire transfer instructions still indicated the bank's previous name.

Exchange rate:

• Dependent on the bank's internal rate. They used a different exchange rate that is not publicly available on the BDO website.

Fees:

Both my PH and US banks charged fees to process the wire transfer.

BDO:

• DST (documentary stamp tax) - dependent on the amount transferred
• Service charge: PHP 500
• Wire transfer fee: USD 25

My US bank:

• Wire transfer fee: USD 15

Turnaround time:

• I processed the transfer during PHL banking hours and later that evening, the money was already in my US account. I estimate the money arrived in my US bank account in approx. 12 hours.

Conclusion:

• The process was very easy, apart from having to physically show up at my PH bank.
• It helped a great deal that I'm a longtime BDO client and that the funds were clearly my savings accumulated over many years. The bank manager didn't ask any questions apart from why I was transferring the money. A simple "I've immigrated to the US" was enough. Without this kind of relationship, the BDO staff would likely have asked more questions.

My father in law got his visa today. We have him booked June 1 for travel. Who knows what changes will happen between now and then but looking for the easiest way for him to get a PCR test within 24 hours of his flight departure to the US.

is there any rapid results testing available at the airport? He s flying JAL to HND-JFK-CVG.

He s in Cavite and wherever he tested last for his medical before going to SLEC in January it took 30 hours to get his results so that place is out.

I'm filling out the I-134 for my K1 petition, and I'm stuck on the Dependents section.

I have 2 of my young adult children living with me and I only claimed one (my son) on my 2021 Tax Return, but in this year 2022, his status changed, he graduated last year from college and landed a job recently earning over 6 figures, but he still lives with me and pays me rent.

I read many sites that indicate you must include any dependent listed on your tax return, but the question on the AOS is; "The following persons are dependent upon me for support" ;

But he is not dependent on me at all, so the question is; do I include him?

Same situation with my daughter, she works and lives with me, however I did not include her as a dependent on my tax return because she earned too much.

If I do include either of them, I can always use the bottom section to add further information.. Any advice would be appreciated.

My wife and I just got married on a K1 visa and wanting to file AOS soon. My 2021 IRS tax transcript does not meet the poverty guidelines for i864, as I was unemployed for 2yrs and 2 & a half months due to living in my wife s country. I just started a new job as of the end of March 2022.

My question is; when filing AOS I864, can I use my 2022 predicted income backed up with paystubs and an EVL?
