RFE: Proof Of Legal Termination Of Marriage - Philippines

Hello!

First post

I am requesting advice and assistance please

My husband is my petitioner, US Citizen, applied for spousal visa I-130 last August, 2023. He just received a Request For Evidence: PROOF OF LEGAL TERMINATION OF MARRIAGE.

I was divorced from my Japanese husband in 2018, and it has already been judicially recognized in the Philippines. However, I no longer have any copies of the foreign divorce decree and English translation. The original was not returned to me after the legal proceedings (was during pandemic, a virtual hearing was conducted online) and all other legal paperwork pertaining to the divorce were destroyed when our house flooded.

I do have a Certified True Copy from the Regional Trial Court recognizing the foreign divorce along with the Certificate Of Finality. I also have a copy of the PSA marriage certificate with my former husband, with annotation in margin recognizing the foreign divorce. Finally I recently obtained a copy of PSA Advisory Of Marriage (Cenomar) that shows my former marriage with foreign divorce decree, as well as my current marriage.

Will these suffice as evidence for USCIS? Do these documents need to he apostilled? Will these suffice for consular interview?

Finally, would it be advisable for my husband to respond online via the USCIS portal? Or is it advisable to send the documents via mail? And if they are sent via mail, will they be returned?

Looking forward to sharing our journey with all of you!

Thanks!!!

Hey,

I have a question, I m a US green card holder, my green card has expired but I have a form 751 which states that USCIS extends the validity of my green card for 48mos from the expiration on my physical green card.

I m going to travel to Canada by land to visit a relative, I believe I can enter Canada with just my greencard and passport, but I m planning to fly to the Philippines from Canada to save time and then from Philippines back to Canada to get my car then drive again from Canada to the US. Both travel will have a layover to Japan btw.

Will I have a problem with the immigration with these travel plans or has anybody done the same without having any problem?

Thank you.

Since my wife's N-400 is pending in San Diego, I tried to get a gage on how fast things are actually going here recently. Searching VJ, some Facebook Groups and Reddit, I came up with 26 self reported cases that have already received interviews in San Diego in 2024.

Here are the stats on those 26 San Diego cases. Number of days days from filing to interview in 2024.

Average time: 141 days
Median time: 133 days
Fastest time: 77 days
Slowest time: 230 days

# of cases in less than 4 months: 11
# of cases 4 to 6 months: 11
# of cases over 6 months: 4

I will have the results of my cultures AGAIN from my second exam on September 20th. Assuming it is again negative, and we immediately mail mine and the children's passports into the embassy with them receiving them Monday morning, how long should it be before we receive them back with the visas? (Our interviews are complete and approved) Thanks.
