Quick summary: My husband (U.S citizen) and I filed the I-130 petition for me- a spouse living outside of the U.S (currently in Canada). Our I-130 has not yet been approved, but we did receive the NOA. My question is- once the I-130 is approved, can I (the beneficiary, wife living outside of the U.S) submit the EAD (I-795) when we submit the green card application? I have heard and read several different answers. We filed with SimpleCitizen and they told us I would be able to submit the EAD, but I ve read elsewhere that is not an option if I m filing from outside the U.S. Help! I would really love to know if I am looking at a few months before I am in the U.S after filing the I-795, or if I ll be in Canada for +1 year until my green card application is approved. Any and all feedback is greatly appreciated! We are NEW to this and learning as we go. Thank you!

Guys - I m separated from my husband right now and it s brutal! is it bad to keep emailing the consulate for answers until I get a reply? An immigration lawyer told me it won t hurt. All I had to do was submit my police check and it s 3 weeks in the process already! consulate: Montr al, Canada

I hope everyone is doing well today. I just need your advice with regards to getting my police certificate. We are still waiting for our form I-130 s approval but I just want to be one step ahead specially of the delays on requiring documents from another country. Me and my husband got married in 2019. I have a police certificate from the Philippines in my maiden name. I m thinking of getting one now on my married name since the expiration date won t be an issue because I last stayed in the Philippines in 2015 and never came back. Since I will be applying as a new applicant because my last name has changed, the processing will take some time. Should I get one now? Or should I wait until it s being asked so the date will be most recent if that makes sense?

I filed N-400 online on June 25, 2020 and when I first filed, the USCIS site said estimated completion December 2020. In December 2020, the estimated completion said January 2021. In January, the completion date said March 2021 and in March, the completion date said April 2021. Now, in April there is no estimated completion date on my case at all. When I checked a couple of weeks ago it said to watch for biometrics appointment, but now even that message is gone. I know Covid has made them behind in processing, but it concerns me that cases filed after mine have already been processed and approved. My field office is Louisville...I think. First they told me Cincinnati then they told me Louisville.

Just curious: Is the case sent back to the USCIS to do administrative process? Or it is done inside the local Consulate Office? Or it is a collaborative work between the USCIS and local Consulate Office?
