Canadians with N-400 Pending

Just figured I'd set this up. I don't want to assume there are very many on here, but we can at least support each other. Might be a nice way to keep track of how fellow Canadians are being treated by USCIS. Give a shout, if you've submitted your N-400 and are Canadian. I'd like to keep track. My last case (IR-1) took a long time to go through in comparison to everyone else that filed for the same. But perhaps the N-400 will offer a quick processing time.

Here are some processing data posted by others on the site: https://www.uscis.gov/sites/default/files/document/reports/N400_performancedata_fy2021_qtr2.pdf.

Here's to Canada (our native land) and to America (our new homeland...soon, I hope!).

Best Regards.

Filing I-485 without a marriage certificate

Hi all! My Canadian Fiance arrived in the US in late April '21 and we got married in early May '21. All we need is our marriage certificate so he can file for I-485, however, DHSS has been down due to a cyberattack. His K1 visa expires in three weeks. I signed up with CitizenPath to help us with his matter and we were told that we don't have to worry about him overstaying since we're married and he can still file for I-485 even after his K1 visa expires. The thing the throws me off is, on the USCIS website it states, "If your marriage certificate is unavailable or does not exist, submit other acceptable evidence such as church records and proof of unavailability or nonexistence". Unfortunately, we don't have church records. I was thinking of writing an affidavit, but not sure if that is enough to prove our marriage.

I just want to be sure that there aren't any other options for us, so I was wondering if anyone is going through the same thing or has gone through a similar situation? Any advice is appreciated. Thanks! :)

Change of Citizenship after Receiving Greencard

I am in a not so common situation and was wondering if anyone here has experienced something similar.

I am currently an Indian citizen holding Indian Passport. I am well on my way on the CR1 visa process (waiting for interview at consulate). I expect to receive the visa stamp in my Indian passport sometime early 2022, soon after which I will be going to the US and receiving a 2 year conditional greencard.

I am also a Canadian PR. Having lived here for 3 years as a PR, I am eligible to apply for citizenship and will be sending in my application on Oct 2021. It won't be approved by the time I have my CR1 interview (takes longer than a year), so I will still be an Indian citizen when I become an LPR.

I expect to become a Canadian citizen late 2022 or mid 2023. I would then have to renounce my Indian citizenship (by Indian Law). What would the change in citizenship and passport country mean in terms of my LPR status in US? Is the LPR status linked to my passport, and how would I switch that to my future Canadian passport?

10 months in- still no NOA2

Hi everyone,

My fiance and I applied for our K-1visa on August 27th 2020. We still have not received our NOA2. We also have not received any RFE.

I have planned the move to the United States from Canada for the end of July. We thought that we had given ourselves a good buffer but with Coronavirus everything is delayed.

In April we requested a follow-up on our case and 2 weeks later sent us an email basically saying "I know this is frustrating but we're working on it.".

We just submitted another request and are supposed to get a response June 30th, but I'm worried were just going to get the same thing. We are anxious to start living together but I can't make any plans until we know this has been approved at the minimum.

I have a few questions:

Should we just switch to a K-3 Visa, or will that delay things even further?

If this response has no information again, how to we contact the USCIS more directly (phone)?

Has anyone ever been denied after such a long wait time?

Has anyone been requested an RFE after such a long wait time?

Thank you,

A

Cannot access IRS tax returns, window just opened yesterday

Hi there, hopefully this is my last question before I file. My window just opened yesterday and I intend to file in the next couple days. I am having trouble accessing our joint tax returns, the IRS website has been giving us trouble for months (i thought my husband figured it out but I guess not). We filed jointly once and we are filing jointly again in the next couple days as well. I intended to use the joint file tax transcripts to show our bonafide marriage...along with other things. Has anyone had this issue? Have you solved it or used something else to show that you filed taxes jointly?

thank you guys so much
