AOS interview documents clarification

So my husband just did his biometrics appt on July 21, and we got a letter today saying his AOS interview is scheduled for August 23. We have some questions and things we want to clarify about the requirements. I did some searching on my own but it got more confusing, so I thought I'd just ask here:

  1. For the Form I-693 and vaccine records - his original medical exam for the visa was in Feb. 2020. I know it says you don't need it if it's already been submitted, but I saw mixed advice here. Some said if it's over a year old you need a new one. Others have said that if you filed within a year of the medical then it's fine. We filed for AOS in Oct. 2020, so we FILED within a year, but obviously it's been more than a year between the exam and his AOS interview. To clarify, does he need a new medical exam in the next 3 weeks, and does he need to bring this form for the interview?
  2. For the I-864 - we also have already submitted this with his AOS packet. I am the only sponsor and was approved as such. However my work situation has changed to self employed, so I'm unsure if I need an updated I864, or updated evidence that I can support him (which is fine)? Should we bring the previous I864 just in case? If I need new evidence I don't know how to show proof of income - half the year i was employed by someone else, and since May I've been self employed.
  3. They ask for "all documentation establishing eligibility for LPR status". I assume that means his visa, our marriage license, and previous I797 from his AOS application. Maybe also I94 and marriage license. Am I missing anything here?
  4. They also ask for "any immigration documentation ever issued to you"... this is very vague. We do not have any of the examples the list (I766, 512, or 571). What do we need?
  5. Finally, they ask for "originals and copies of each supporting document you submitted with your application". Are they saying they want originals and copies of the ENTIRE I485 packet (which they clearly already have)? This seems excessive but I wouldn't put it past them.

I know this is alot to ask - but I know that USCIS has a habit of asking for things they already have... or saying you don't need to bring something and then you get there and they ask for it after all.. so I want to be 1000% sure that I'm clear about what we do and don't need. Hello everyone,

Melissa here again.

I was wondering if there was anyway I could apply for like an EAD or any permission to work in the US (without a SIN or work visa) while waiting out my interview. I am currently doing a month-here, month-there situation between Canada and the US. I quit my job as a Registered Nurse back in April 2021 to come be with my wife due to personal and health-related reasons.

Instead of going back to Canada, I was wondering if there was any legal and feasible way to start working in FL, US while we wait for my interview.

I am having great difficulty finding an answer to this and I believe it must be a common situation with these long processing times.

I am in Texas where the DMV will abide by SAVE case checks and nothing else, there are no temporary licenses in Texas and Real ID is the only license provided.

Situation is; I have my I-797C NOA receipts for both the I539 extension and I765 EAD extension - both are processing and will be well in to 2022 before approved. My drivers license expires Sept 1, 2021 based on the expiration date of my current I-94, visa and EAD.

I desperately need to renew my drivers license!!

Has anyone been approved with SAVE based on receipts rather than approvals?

I-539 for L2 does NOT qualify for the automatic 180 day extension and I have a feeling that is where the grey area lies.

I called USCIS and the agent did not know what SAVE is and basically provided canned responses.

HELP!!!

N-400 Question - Part 9 - Time outside the US

Hi all - haven't used the forums in a few years, but looking for some guidance now that we're working on the N-400 for my husband. I hope I am posting this in the right spot!

I'm a US citizen, we've been married 11 years and he's been living in the US for 3 years (hasn't left at all), which should mean he's eligible to apply for naturalization. I'm a bit confused by Part 9, which asks how many days you've spent outside the US in the last 5 years and how many trips he's taken outside the US in the last 5 years.

So, would I put 730 days (2 years) as the number of days spent outside the US in the last 5 years? Does living outside the US count as a trip? Or would I answer the question as if it were the last 3 years (instead of 5)?

I'm probably over thinking this, but I just want to avoid any potential delays. It's extra confusing because the rest of the application seems to make allowances for the 3 years (if married to a US citizen) vs. 5 years (if not). I've been poking around online, but can't seem to find a straight answer, and of course I can't get through to anyone on the USCIS phone number

K1 to CR1?

Hello, This is my first time writing in the forum.

I would like to ask for a little advice, My fiance and I are applying for a K1 visa, we are in the NVC part of the process, we received our NOA2 last march but we haven't received any kind of information yet.

We are tired of the wait and we want to cancel our K1 and get marry outside US and start a new process with a CR1 visa. The question is at this point is it worth it to cancel a K1 visa and start a new process? or is it better just wait?
