When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 15 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Abandoned AOS and now regret it

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

I recently discovered this forum and have been reading avidly all of the great advice and guides.
I am looking for some advice, based on the far greater knowledge of forum users here and perhaps past experiences, on the best and quickest way to proceed in my circumstances.
Circumstances:
- My long term partner (US Citizen) and I (UK Citizen) have been together 7 years, during which time we have each visited UK and US, respectively multiple times per year. In my case, on an ESTA.
- We both have good jobs, plenty of savings and own houses etc
- I intend to relocate and work in the US on a permanent basis as soon as possible.
- I am exploring options for relocated through work with my current employer and obtaining visa sponsorship that way, but that is proving slow and frustrating.
- Due to a recent change in circumstances (partner is now pregnant and this will be our first child) I am planning to take a career break and spend as much time as possible (ideally the entire term of the pregnancy and child birth) in the US to support my partner.
- In an ideal world we would legally marry and got the CR-1 route, however, the 12-15 month processing time is clearly not going to work given timeline
- K-1 visa appears to be the more likely and slightly quicker option, but again, 6-12 month lead time would not work either - even with potential short visits to US whilst the K-1 application is pending.
- My current thinking is applying simultaneously for a B-2 and K-1 visa is my best bet for getting to US in the short term and being able to stay for 6 months (+ possible extension?). However, having read other forum posts it appears that the success rate on the B-2 applications is quite low?
- Other option I can see is to travel on ESTA with the intent to visit/support during pregnancy, get married and then apply for change in status, work authorisation and advance parole etc. This feels super risky though.
Any and all thoughts welcomed and appreciated!

I m seeking advice on how to properly file the correct motion after a Humanitarian Parole application submitted by my wife was denied by USCIS.
The reason for the denial was that they felt there was no urgent humanitarian reason or significant public benefit to justify granting parole at this time.
My wife is a Ukrainian national who fled the war and is currently living in the United States with a pending asylum application. She filed the parole request to help us reunite, as I am currently living in Italy under refugee protection.
We are now preparing to respond but need help understanding the right next step. Should we file a Motion to Reopen or a Motion to Reconsider?
If anyone here has experience with similar cases or can guide us on how to proceed including what kind of evidence could help show urgent humanitarian need we would truly appreciate your advice and support.

2 RepliesI am on STEM OPT, adjusting from F1, and curious about the answer to the Question 15. I am unsure whether I need to enter the end date of my STEM OPT EAD card, or leave it as D/S which is written in my I-94? Problem with the first option is, there is still a grace day to stay so technically it is not the exact "end date" Any thoughts on this new question? Thank you.

I know the next step is a medical and interview, but is there supposed to be some kind of instructions sent our way? Or are we supposed to figure out how to
book the medical and interview ourselves? This is the screenshot, and we do not have any appointments booked for anything, just wondering how to proceed from here?
