When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 20 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

5 RepliesI m a US citizen who submitted an I-130 in October of 2023 online to request my Canadian husband s green card. It was received and still says case is still being processed by USCIS . It appears no progress has been made in almost 2.5 years. Every similar timeline was processed long ago. It s as if our paperwork has been completely forgotten and will never be done. Our lawyer has submitted 2 delay requests and called multiple time with no results. They just say there are delays (even though everyone else gets theirs back in a year. Has anyone else had this and what should we do?

I need advice regarding filling out the N400 form. I am applying based on the 3-year rule, and I will be eligible to apply in a week.
1) Before getting a green card, I had to voluntarily withdraw my application for admission at some point. I was issued an I275 and later received my immigrant visa and had no problem entering the country. In the 400N form, do I need to respond yes to the question asking if I have ever been removed or deported from the U.S.? And if I have ever been arrested, cited,detained or confined by immigration official for any reason, and if I have ever been placed in removal, rescission or deportation proceedings? I still have the I275 form, and I am planning on attaching it in the addition evidence section, but I wanted to know if any of these questions apply to my situation.
2) The N400 asks about the travel history for the last 3 years. Since I am applying 3 months earlier, the 3 month period covers the time when I was not in the U.S., because I was not a resident at that time. Do I need to mention that?3) I know that NVC has been very particular about the way that the documents have to be scanned and attached. Is there a rule that USCIS follows? What document orientation is required?
4) I know that good moral character used to mean not having any criminal record. I believe that has changed now. Do I need to attach letters of volunteering, a recommendation letter from work and things like that?

5 RepliesHello! I am a nurse and i will be having my US embassy interview soon for EB3 visa category. My problem is that I worked in Qatar as a temporary covid nurse from april 14, 2021-october 13 2021 (5 months and 29 days). During our stay, our employer never issued Qatar residency and we were sent home when the covid cases are getting less. I am very anxious that they might ask for police clearance. With my non resident status in qatar, i know i am not eligible to apply for qatar police clearance.What should I do?

2 RepliesI haven t been here in a while, kinda in an extended holding pattern. She was tripped up in medical, x-rays like is not uncommon. She made it through finally a few months ago. With the previous scheduling at the embassy I was able to search & schedule an interview. I had to cancel once she got tripped up at St Luke s.
I just logged into the new scheduling portal, didn t get far. It basically said, due to reasons with application, or other reasoning, log out for at least an hour. I m on the page, any answer on why it s a dead end? Yes I realize there may not be any open slots.
Why am I still here? Well, if possible I d still go through everything. In the interim I ll do the visiting thing. Since I m going over there, I thought we could try getting to the next step together.
Is it a fee issue? I m sure I paid earlier, no doubt long expired now. Anyone want to schedule an interview for us?? I ll check things when I get there. What type of proof that the medical is complete and passed? I hate to ask, is it 6 months then one starts over?

IR-5 Interview – Update I-864 After Job Change?

2 RepliesMy cousin (U.S. citizen) petitioned her mother (IR-5). Interview is in April.
She submitted the I-864 last September. Since then, she changed jobs, but her income stayed about the same or slightly increased. 2024 income was ~$42k, household size is 3.
We ll bring updated pay stubs and a current employment letter.
Should she complete a new I-864 reflecting the new employer, or is the original fine as long as we bring updated proof of income?
Has anyone done this without issues?
