hi

i had visit US alread y in august for 10 days stay and was back in October for 2 weeks vacation. I plan to fly over in January 2008 and stay my 90 days on a touristvisa,, then if things work good we plan to apply for a fiancee visa.

I had heard that I can be denied to come to Us in the by the immigration staffs. have someone heard or know about that. Someone told me that people who travel to frequently can get problem, anyway I had do my visit there short. Somewher I had read its ok to visit the countr y total 180 days/each year.

Frequent visits can be a problem; it is seen as a "red flag". Yes, you can be denied entry if you visit for too long or too frequently. However, there is no hard-and-fast rule as to how much is too much, that is purely at the discretion of the immigration officer at the point of entry.

The best thing to do is to carry proof of your ties to your home country - return ticket, mortgage statements or lease on your home, bank statements, utility bills, etc. This will help you if you are asked to prove that you intend on going home at the end of your 90 days.

Frequent short visits tend to raise fewer flags than back to back long visits. Once you go over 180 day in a year, the chances of entry being denied rise significantly. It sounds like you were here only about 24 days in 2007, so you should be ok in January but after a 90 day stay, coming back again before the K1 visa is in hand starts to be risky.

I think it also depends on who you get at the POE. When my USC husband was still my fiance, I visited 5 times in one year, but only for a week or so each time. The 4th time I got pulled aside for secondary screening, got asked a lot of questions about my job in Ireland, where I lived etc etc. Towards the end the immigration officer asked me why I was coming over again, and I said to visit my fiance. She said I shouldn't mention the word fiance, it could get me denied! And to make double sure they took my VWP slip when I left. I was also only given one month rather than the usual 90 days stamp, which was fine, and all went well with that visit.

The next time (5th visit in a rolling 12 month period), I was prepared. Brought the deeds to my flat, electricity bill, a statement from my employer stating when I was expected back, ticket to visit my parents in Switzerland (leaving from Ireland) the next month etc. I handed all that together with my VWP and passport to the immigration officer. He didn;t even look at it, just read the VWP card and stamped my passport for 90 days.

I have a K1 that is pending right now, and I visit the US from Canada every second month..

I can honestly say that I haven't had any problems going through the border .

The one thing I do is to NOT offer any more info than they ask. I also say I am visiting my b/f and not call him a fiancee.

It is IMPORTANT to have documents ready in case they ask any questions. Except, Last week when I went into the states, I had all of my school transcripts etc... documents with me, and they asked WHY I was carrying them with me.

Have rent/ job papers with you in the event that you have to produce them.

I have been through 5 times now, and every time it is NERVE wracking, it just depends on the guard you get... and what mood they are in..LOL

So, is the fact that you have a K1 pending not known to the immigration officers? I had assumed that info would come up on their computer screen or something and then they'd ask more questions - maybe not?

hi.

I had this problem when entering the us back in september,

I was in america on a tourist visa from february to may 2007 for 89 days. When i came back on a tourist visa on 17th september they asked me to go wait in a room. I waited for an hour and they asked me all about my purposes for the trip, and ties back home. The only reason i think they let me in was because our fiance visa had been approved and i convinced them i was going to come back to england in the allotted time. My adivce is to

A) Have details of your return flights

B) Bring any evidence indicating you must go back home (ie: job confirmation, ownership of property, family ties)

C) Tell the complete truth.

If they find out you are lying about anything they will not let you in.

Hope this helps you.

I've made many trips down to the states and never had a problem.

I usually just say "I'm visiting friends, etc. etc."

The last time the officer did ask me "When was the last time you were down?" I stated "last month" and that was all. He didn't ask me any more questions and let me go on my way.

I went to visit my fiance in the US at least once a month for the last year and didn't have any problems at all. Although I gotta say that always had my return ticket and employment letter with me, just in case the immigration would give me a hard time at the airport. Fortunately it never really happened.

Just make sure that you don't overstay the 90 days tourist visa permission, otherwise you're gonna get into trouble with the immigration.

There is no problem visiting the US during the K1 process, the only thing is that as soon as you get the fiance visa your B2 tourist visa will be cancelled and you're only allowed to enter the US under the K1 visa.

I will come to visit my fiancé at the end of march, and yes i gonna to say that i'm there to visit my BF.

The reason is, the first time i came to visit him last year in August (it was also my first time in US since 7 years), we was not on the K1 process. And i don't know nothing about K1 or visa stuffs. So It was at Chicago airport.

I was there with my daughter. She was a bit sick on the plane, some fever, and she was asleep in my arms. After a long long time waiting in the long long line, it was finally our turn.

The officer took our passport and asked me the reason we come in US.

I answered very honestly that we're there to visit my fiancé (i used that word cause as we are in love, and that i don't like to say just BF as we are more than that).

The officer started to be suspicious, i was wondering why. He asked me to see return ticket, and as my daughter doesn't have the same last name than me, he asked a lot of question about that. I use to travel with all paper i need, so it was not a problem to give him proof. He even asked me the birth date about my daughter.

It was so stressful as i was wondering why all that questions, and had my sweetie sleeping in my arms, she is 5 and she start to be heavy. Finally he let us go. If he kept us 5 mn more i think i will cry cause i was really don't understand why it was like that.

And i don't know if its related but a guy from the airport (i don't paid really attention about his uniform) was just beside my luggage and helped me to put it on the trolley.

Second time in December, i told the officer that i was there for vacation and visit my BF, he asked me when i was there before, i answered this summer, how many times you stayed, about 10 days. And that's all.

Nobody to help me for luggage this time and it was more big and heavy cause the winter time.

Kisses

Marco came from October to January (like 80some - days) and was very nervous about entering again in February for 86 days. He got in in Chicago on January 22nd and they gave him the full 90-days. They didn't take him to secondary questions or anything, just said... have a nice vacation and stamped his passport. He's here until May! - Well unless the USCIS approves us sooner and he has to go back for the interview....
