I HAVE TWO QUESTIONS CLOSELY RELATED TO EACH OTHER; I'LL START WITH A BRIEF SUMMERY OF MY SITUATION.

IN THE BEGINNING OF NOVEMBER I HAD MY INTERVIEW FOR NATURALIZATION IN SANTA ANA, CALIFORNIA; THE INTERVIEW WENT WELL AND THE INTERVIEWER TOLD ME AFTERWARDS THAT SHE WILL APROVE ME; A MONTH LATER ON 2. OF DECEMBER I RECEIVED AN EMAIL FROM USCIS STATING THAT MY CASE HAS BEEN UPDATED; I LOGGED INTO MY USCIS ACCOUNT AND SAW THERE THE "CANCELATION NOTICE FOR REQUEST FOR ADDITIONAL EVIDENCE"; A FEW DAYS LATER I RECEIVED A PHYSICAL LETTER FROM USCIS DATED 5. OF DECEMBER STATING THAT THEY DO NEED AN ADDITIONAL EVIDENCE AND IF THAT EVIDENCE ISN'T RECEIVED BY 2. OF JANUARY MY APPLICATION WILL BE DENIED. I AGAIN LOGGED INTO MY USCIS ACCOUNT BUT EVERYTHING THERE LOOKED JUST AS BEFORE - THE CANCELATION NOTICE AND NOTHING ELSE. I HAVE CALLED USCIS AND SPOKE TO 3 "TEER 1" AGENTS AND 1 "TEER 1" SUPERVISER; ALL OF THEM HAD NO IDEA ABOUT THE PHYSICAL LETTER AND ONLY SAW IN THEIR SYSTEM WHAT I CAN SEE IN MY ONLINE ACCOUNT; THEY ALL CONFIRMED THE CANCALATION BUT COULD NOT HELP ME WITH THE LETTER; THEY ESCALATED THE CASE TO TEER 2 AGENT THAT CANNOT BE REACHED DIRECTLY AND I AM AWAITING HIS OR HER CALL NOW, LEFT WITH ONLY 2 WEEKS TO GET UPLOAD THE POSSIBLY NECESSARY EVIDENCE.

HERE ARE MY QUESTIONS:

1. SHOULD I REACT TO THE PHYSICAL LETTER AND SEND THE USCIS WHAT THEY ARE REQUESTING OR SHOULD I IGNORE IT SINCE THEIR OWN AGENTS ARE TELLING ME THAT ACCORDING TO THEIR SYSTEM I DON'T NEED TO SEND ANY ADDITIONAL INFORMATION?

2. THE EVIDENCE THE USCIS IS REQUESTING ARE MY TAX FILES OR IF I BELIEVE THAT I AM EXCUSED FROM FILING TAXES THEY WOULD LIKE MY EXPLANATION AND DOCUMENTS THAT WOULD SUPPORT MY EXCUSE FROM FILING; MY TAX SITUATION IS AS FOLLOWING: I HAVE NEVER FILED TAXES AS I HAVE NEVER HAD A PAID JOB SINCE I MOVED TO THE USA; I AM GETTING MONTHLY WIRE TRASNFERS FROM MY FATHER AS A GIFT SINCE I MOVED TO THE USA; THE TOTAL AMOUNT OF THE MONEY I RECEIVED FOR ANY OF THE YEARS IN QUESTION IS NEVER MORE THAN 16000 $ (I LIVE IN CALIFORNIA). BASED ON MY INCOME I DON'T COME ANYWHERE NEAR CLOSE TO THE AMOUNT NECESSARY FOR FILING; IF I WILL RESPOND TO THEIR LETTER I AM PLANNING TO SEND THEM BANK STATEMENTS FOR THE YEARS IN QUESTIONS SHOWING THE TRANSFERS FROM MY FATHER. DO YOU THINK THAT SHOULD BE SUFFICIENT OR DO YOU THINK I DON'T NEED TO SEND MY BANK STATEMENTS AND A SIMPLE EXPLANATION WHY I AM NOT FILING SHOULD BE SUFFICIENT?

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

THANKS TBONETX FOR REMOVING THAT; SORRY ABOUT THE CAPS BUT IT IS LIKE A RELIGIOUS THING WITH ME; THE ONLY THING I WROTE WITH LOWER CASE IN THE PAST 20 YEARS WERE MY IMMIGRATION APPLICATIONS; NO SHOUTING MEANT, JUST A CLASSIC LATIN FANATIC HERE :)

Fair enough, it's your choice of course, but just do be aware that in forum netiquette it's absolutely considered 'shouting' and pretty rude.

Are you single? If you are the threshold for filing is $14,600. What other income do you have? I assume you're not living off $16,000 in California, just health insurance alone would be more than that.

how are you excused from tax filings ? as a green card holder you are required to file tax returns.
