Hello,

I have a pending withdrawal Mariage application at NVC ( we are divorced for more than one year now ). 

I got married few months ago and my question is: can i submit I130 application for my new wife while the old one still pending withdrawal?

As long as the second marriage clearly occurred after the first divorce.

 

Expect lots of scrutiny with that fast timeline, especially if you are bringing multiple people over from the same country, or bringing over someone from your country that you knew before marrying a USC.

from your post on another's post, your case went to NVC 9/2023 and your post May 2024 , you were planning marriage to the Canadian

 

your new case will be under much scrutiny as you did not wait for a divorce before starting new relationship

you must, you understand, include the dates of meeting the new wife online and in person 

your progress forward will be more difficult than the last marriage

 divorce was finalized on 03/21/2024. And my new marriage happened like 4 months ago. Do there is a big gap.

My divorce was finalized 03/21/2021

And my new marriage happened just 4 months ago. Should i just go ahead and submite the new i130 while waiting for the old the application to close? I am sure the new one will take more than a year before they touch it.

The question which will be asked is about the timeline of starting your relationship with the now spouse .. yes,  you waited until the divorce to marry, but when did you first meet online and start that relationship. And if it was after the divorce was finalised, then marrying someone you have only known for 4 months will also be a red  flag . None of those dates on that timeline with ever change , no matter whether you file now or wait.

And it's been like 4 months married with my new wife that I am trying to file for her the i130

My divorce was finalized in March 2024. And my present marriage happened 3 months ago! Is there a role or law that say we need to wait 3, 4, 5 years to get married again? 

Why red flag? I didn't bring my ex wife to the US. The application was pending in NVC. If i did brought her here then divorce and married again then, yes, it's a big red flag. Also i am from Morocco, we don't have dating in our culture/religion and immigration are aware of that. You might meet a girl and go to her parents house and ask for her hand If she agrees, you can marry her the next day. I will be understanding if you are talking abt K1 visa, You need to know each other for a while and meet in person.  

 

Summary: divorce Finalized in beginning of 2024 ( the application in still in NVC waiting withdrawal and she never made it to the US) and i got married again in August 2025.

I have  a friend,  he went to Morocco, his family found a wife for him, he did marry here during his visit and he applied for the I130 and it was approved ( as i sai; Its all dependson the country you come from and the culture/ religion) . You just need to provide marriage certificate and weeding pics. Maybe a honey moon pics as well.

But can i apply while still the other NVC application is a waiting withdrawal? That's my only concern, i don't worry abt anything else.

Referring to what I bolded above, there are no such questions on the I-130, but yes somebody will be curious and you may be called on to explain at some point.

Facts are cheap...knowing how to use them is precious...

Worth noting that given the current political situation, it might not be a good idea to have minimal evidence for a red flag marriage in a high fraud risk country.

 

You can still apply, but “marriage certificate and pictures” is less than what many of us on our first marriages from low fraud countries submit.
