when we got approved for marriage based green card we were married less then two years . But he enter US after two year marriage.

I’m a bit confused and need clarification.

Last year, my husband entered the U.S. after we had already been married for over two years. We got married in South Africa. When he arrived, he was mistakenly issued a two-year green card instead of a ten-year one. We filed an I-90 to correct the error, and it was approved — the card was updated to a 10-year green card.

However, this past weekend we received a Notice of Removal of Conditions, which shouldn’t apply to us. I’ve called USCIS several times — one representative said those letters can be auto-generated because the system might still be referencing the original two-year card, while others sounded unsure since I provided two different receipt numbers (one for the old card and one for the corrected one).

I told them I wanted to schedule an in-person appointment to clear this up, and they said someone would call within 72 hours to confirm the request, but it could take up to 30 days to actually schedule the appointment.

My concern is that if their system is still tied to the old card, it shows an expiration date of 02/2026. We don’t want to risk traveling and having my husband’s card flagged due to a USCIS error.

Some people are advising us to file another I-90, while others say to wait for the appointment.

I just called USCIS again after work, and they told me they canceled my appointment request because it doesn’t fall under one of the reasons they normally schedule appointments for. They advised me to write a letter to the address listed on the notice explaining the situation in detail. I guess at this point, I have no choice but to do that and hope it clears things up.
A year later getting conflicted information. Even an online lawyer saying hes not sure . We decided to be safe going to file to remove conditions. Because sending a letter will take time for usics to respond.

Don't!  It's IR-1 status.

Contact your Congressman's immigration liaison immediately.  You'll fill out an easy form (perhaps available on their website) to give permission for their office to intervene on your behalf.  The office has contacts within USCIS that you have no prayer of reaching.

Thread is shifted from the CR-1 Case Progress subforum to the main CR-1 Process forum.

Concur.  Filing to remove conditions will only add to the confusion.

And all congressional case inquiries are tracked in a separate database from the normal case inquiries, which is just as valuable as having the right contact number.

This year it also apparently is advantageous on speed of response if the senator or congressman is Republican, so if you have an option between the two parties, I’d choose one of those.

I agree, do not file an I751 as this is a relatively common situation given the systems USCIS uses.  Reminder letters often go out to those where it does not apply, and others do not receive a reminder letter where it does apply.  If you file an I751, you are simply throwing away the filing fee as the 10yr GC is correct and you can prove that with your marriage certificate along with the endorsement in his passport upon entry.

Pursuing a clarification with your congressperson or senator may help.  You can also try the CIS Ombudsman.

Good Luck!

Did you call the YouTube lawyer about this today?

I-751 doesn't apply. You were married for 2+ years when he entered to the US and became LPR.

We did and he wasn’t even sure and he said he will look into it. He said we might be wrong or right

Do NOT file an I-751......the notice was a mistake.  It has happened before.
