I am a Chinese citizen and have held a U.S. green card for 7 years. During this time, I traveled abroad twice, each trip lasting 2 months, for a total of 120 days.

My case is being handled at the USCIS Queens Field Office.

  • At my first naturalization test, I failed because I wasn’t well prepared.

  • On January 6, 2025, I had my second naturalization test. I passed the history, reading, and writing parts, but the officer did not continue with the N-400 application questions or the “Yes/No” questions.

  • Instead, the officer told my attorney and me that I would be given a third chance for an interview. The officer also took the original court disposition for a February 24, 2024 incident when I was arrested after a fight (which I had already truthfully disclosed on my N-400).

Since then, I have not received any correspondence from USCIS. My case status on the USCIS website still only shows the same update as in the screenshot attached.

I have consulted two immigration lawyers, but neither has encountered a case like mine. Even teachers from naturalization prep classes said they have never seen this situation.

👉 Has anyone else experienced something similar at the naturalization interview? What should I do next? I would be very grateful for any advice or shared experiences.

I would like to know what stage my case is currently at.

Will I still need another interview?

Does this status mean that my case is under review?

Is USCIS deciding whether to approve or deny my application?

If my application is approved, does that mean I will become a U.S. citizen without having to attend another interview?

I don't see how it could be approved if (a) you did not get the questions and did not sign, etc. (b) you were told you would get a "third chance" which implies you did not get approved.

 

Disclosing your incident in February 2024 does not mean they can ignore it because you were truthful. Also, you said you had a court deposition but not what happened. Is the case pending? Was the case dismissed? 

 

Have you tried calling on the phone or making an infopass appointment?

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Not a lawyer, but from what I know, the court disposition seems to be the issue here. Depending on the outcome of the disposition which is unknown from your post, it could make you ineligible for citizenship.

 

Additionally with the additional discretion granted to officers related to Good Moral Character (GMC) from August 19 change to policy manual, a fight in you past could be regarded as a mark against GMC and lead to a denial.

 

I think the officer wants to review your case with superior, and if they can overlook the charge/ disposition, they will call you for another interview to ask the security questions. If not, I think they might deny the case.

Two chances is to pass the history and civics test, which I understand OP passed this time. I think the third interview is to continue to the security questions.

To be honest I wouldnt have applied  for Citizenship so soon after your court case. I would have waited another 5 years or so. Your case appears to have GMC issues regardless of the outcome of the case.

My case involved a dispute where I got into a physical altercation with another person. We were both taken in by the police, but neither of us decided to pursue charges. The case has already been dismissed and closed by the court. I tried calling, but no one answered.

Two chances for language and civics test! Third interview is not related to language exam so it doesn't contribute to the count. You can have multiple interviews if USCIS needs more info.

I have consulted lawyers, and they gave me the same opinion, which is the same as yours.  

My case involved a physical altercation with a woman. We were both taken to the police station, but neither of us pressed charges afterward. The case has been closed, and I was not found guilty.
