Its impossible for anyone to know why the CO might have been suspicious of you. I bet its not from the tax return, but no one knows. It may even have nothing to do with anything you submitted.

 

In anycase, the CO will look at the totality of all the data they have to judge whether your marriage is real or not. They are very good with their vast databases and experience at determining fraudulent VISA and marriage based applications.  So don't worry, they won't decide just on one ignorant tax error.

currently I got the 221g AP Blue slip after the US Embassy interview to send Proof of money transfers that we sent to each other which I submitted the same day. And She preparing to Visit UAE to live here until AP Resolves.

Doesn't matter when. Would you want USCIS to doubt your marriage 5 years later and revisit your green card when you try to naturalize? I'd try to fix it sooner.

Neither filing jointly nor separately, since he cannot file taxes, there is no filing jointly; he doesn’t have an SS#. The way to do it is to file as head of household; that will make her head of household.

She has to pay more taxes, but it will do the “married” part. And yes, she can amend the taxes anytime, even when he arives  in the US.

Filing as HOH requires special requirements.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

There has to be a qualifying dependent other than the foreign spouse....and IRS must consider you "unmarried" for tax purposes.

Wow, that is all so incredibly wrong

 

1) You absolutely can file taxes without an SSN for your foreign spouse. You just need an ITIN which can be requested by filing form W-7 the first time you file jointly (even without an SSN or ITIN). 

 

2) She can't simply file as head of household for many reasons, including:

   - There are requirements such as paying at least 50% of the cost of keeping up a home. She may not qualify if she is spending 6 months+ overseas and getting money from her husband.

    - You need to have a dependent parent that you pay for, or a dependent child living with you that is not taken as a dependent on anyone else's tax return. There is no mention of of this in the thread that she qualifies for this.

    - You must NOT be married per the IRS rules, which is not going to help your case with the USCIS especially if you don't qualify. 

   - The IRS considers you married if you were legally married before the end of the tax year.  So per the IRS rules, they are considered married

 

Hence, For the same reasons they can't file as single, they can't file as HOH.

 

If you have been filing as HOH without meeting the above qualifications then you have been committing tax fraud and should amend immediately.

do not need SS # to file joint taxes

the USC does MFJ and follows the IRS instructions for getting ITIN (form W7) 

ITIN is assigned and used till i got my SS# / My wife filed this way for each year i was still not in USA

This is what they do, that’s their job. They would try to intimidate you and want to see if you have different versions of the story. For my Green Card, the officer didn’t let me breathe for a second with his questions. I almost freaking cried in front of him and my wife. He got me so confused, set some traps but thank God I had most of them right because everything was real. The only two questions I couldn’t get the right answers, my wife was there and correct me. It was just a name of main road in a place we used to live abroad and can’t remember the second one. 
However, from what you said about your case, I believe you would be fine.

Hi, My Wife received an Email from embassy to provide Travel Summary of all 5 trips to visit me along with the Explanation of money transfer purpose and from who to whome.
