Did your USC wife make out her tax returns as Married / filing MFS or MFJ?

Did she claim you getting a ITIN?

Have you 2 commingled any assets?

 

those are things that help a case when coming from a high fraud country

 

It will be extended AP but all you post sounds good

She file Taxes as single

No ITIN claimed

No assets together 

She just visits me every year in UAE on her UAE Spouse visa which is under me

Ooof. Well that's not good news for your visa application, but more importantly she's technically committed perjury by filing as single when she's actually married. https://www.irs.gov/filing/filing-status

 

She needs to amend her returns asap.

Because single means "not married" 

no wonder the CO had suspensions that the relationship (marriage) was not real

that was a big mistake to do taxes like that

 

you already had interview so there is no application ongoing / there is a petition she did for the spouse and your DS 260 for the visa

 

she needs to do 1040x filing as married

MFS (married filing separate) or MFJ (married filing joint and the W7 for your ITIN which is in her favor for lower tax bracket

She she has told one section of the US Government she is single and the other she is married.

I would appreciate if any one can give any solution, but i have seen some people i know personally who filed as single and still got approved? Are they going to rule out all the evidence that include her visits before marriage in dec 2018 (For A week) in Dubai to meet me, then my visit to Egypt to marry in sep 2020 (24 Days stay), and her visit to me after in Feb 2021 (4 Month Stay) after marrying, Then in July 2022 she filed the petition that approved in July 2023 and got DQ in Oct 2023 and IL in july 2025, again she came to visit me in Feb 2023 (2 Month Stay) along with her parents (But her parents stay was 7 day), Her Last visit to me was for 7 months on UAE Spousal visa (Feb2024-Sep2024) between all the time we submitted the chat and call logs across different time on different apps from 2020-2025, Pictures together and etc. If there is any Tax related item they wont ask us to submit updated tax documents (We have a joint sponsor in our case). We weren't aware of the tax filing as single issue. Between all these years i was sending her money for family support and one time she sent some money to me too (We submitted the receipts as Proof of Money transfers) I would appreciate a solution rather then a criticism that i still fairly welcome.

Maybe. Tax return transcripts are still needed for I-751 and N-400. Even if it flies through right now, it may be a problem in the future.

 

The solution is amending taxes.
