Hi everyone,

 I’m currently navigating the immigration process and would love to connect with anyone in a similar situation.

 I originally entered the U.S. with a valid visa and was legally allowed to stay until October 31, 2021. However, I overstayed and left the U.S. on September 13, 2022, which means I was unlawfully present for a little over 10 months. As a result, I’m subject to the 3-year bar due to unlawful presence (over 180 days but under 1 year).

 

 I got married to a U.S. citizen outside the U.S., and we’re now going through the immigrant visa process. My I-130 was approved, and we have submitted the I-601 waiver. Right now, we are waiting at the NVC stage, hoping for a positive outcome.

 

 I would really appreciate hearing from others who:

  • Have gone through the I-601 process from outside the U.S.

  • Were dealing with the 3-year bar (not 10 years)

  • Can share timelines, experiences, tips, or moral support

 

 Thank you so much in advance. This process is overwhelming at times, and hearing from others who've been through it would mean a lot!

Why file a I 601?

I think Boiler was wondering why not just wait the ban out if it’s only 3 years - rather than filing the I-601 which has a similar processing time.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

However, I overstayed my visa and departed the country on September 13, 2022, meaning I was in the country illegally for just over 10 months. Therefore, I am subject to the 3-year bar for unlawful presence (more than 180 days but less than 1 year).

 

 

 

I married a U.S. citizen outside the United States, and we are now in immigrant visa processing. My I-130 was approved, and we have applied for the I-601 waiver. We are currently in the NVC phase, hoping for a positive outcome.

 

 

 

 

 I would really appreciate hearing from others who:

 

• Have gone through the I-601 process from outside the US

I agree, about waiting it out.  In four months the three years will be done, and you can likely schedule an interview for around that time, and avoid the I601 delay.

If you read thru instructions for the I 601, you will see it says after interview (you may be told by CO you can file this form)

the form is not sent in with the I 130 petition
