My fiance/girlfriend is worried about this. She has been denied B2 visa 3x in the past 8 years. The last time being Sept 2023. This was all before we met. She said no reason was given but thinking back to it, she says didn't answer the questions according to what she put down on the forms. The first two times was because she had someone fill out the form for her, and I guess they did not prepare for the interview together.

 

Fast forward to today, we have been talking for 8 months now, already met once, and plan to meet again in December.

 

I want to do a K1, but she is worried about the previous B2 denials and is suggesting maybe we go with a CR1 instead because we heard that you can at least dispute the CR1 denial. However, barring the B2 situation, there is nothing wrong with our backgrounds.

She would know why.

 

Why did she have someone fill in the form, a simple process.

 

What was different in her answers

She just says they did not give her a reason. And when I mentioned that everyone says they give you a reason, she just says I'm not the one who went to the interviews so I don't know.

 

English isn't her best, so that's why she had help from people who do the immigration stuff(i'm not exactly sure if it was an agency or whatever), but I don't know what happened with that because she and they did not prepare for the interview at all. I will have to ask her to be more clear before we proceed I suppose.

Ask if she falsely claimed to be married when she applied for the B2 visas.  That happens, sometimes, when agencies fill out the forms.  Generally, B2 denials, if due to lack of ties to country, will not affect a K-1 or a CR-1.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I have been to the interview and they do.

As long as she or whoever she had fill out the DS160 did not materially misrepresent her, it should not be an issue.  My now wife was denied a B2 twice and we had no problems.

Yes, she got the standard “not enough ties to her home country” reason.

Most are denied for presumed immigrant intent/lack of ties to home.   So if that was the reason for the denials, she should be fine for an immigrant visa.

 

However, like Crazy Cat said,  if she (or the ‘agency’ she hired) made a false claim on a B-2 application, that could complicate things significantly.

She just says they never gave her one or else she would have known the subsequent times she filed.

 

She's from Thailand. Not sure if it matters.

So we are supposed to believe that she went 3 times and on each occasion she was not informed?

 

And you do not know how her application and the truth differed.

It depends on why she was denied. If it was because she didn't have enough ties to her home country, there shouldn't be a problem. If she lied (misrepresentation) on any of the applications, yes, she could absolutely be denied. Just because someone else filled the forms for her, does NOT mean she isn't responsible for any falsehoods on the applications as she signed them. Without knowing the reason/reasons for her denials, no one can give you an answer without it being pure speculation. The only way to find out for sure why she was denied is to file FOIA.
