Can i file for VAWA if i have court hearing for deportation???

Hello Everyone,

 

I am new to this group, but i have seen that so many people has been helped with their questions. 

 

I am married to a USC who is in the NAVY for almost 2 years, but this person has been abusive, extorting for the most part, I am worn out and do not think I can continue with the married. Prior to our marriage, I been going through immigration court hearing for overstay in the United State, but when we got married we put in a family based petition which I believe is helping my court hearing, there is no final determination on my courting hearing at this time. I am tired of being abused because of my short comings. I want to leave the marriage and file for VAWA. Does anyone think my court hearing for deportation would be affected if I leave the marriage and file for VAWA? I am trying to find the possible best option for me.

The person to ask is your Immigration Lawyer. I assume you are looking for cancellation of removal.

There is a VAWA thread you can follow and read through . Some have been through removal .

 


Assuming you have an attorney..put together a Statement of Abuse and gather your evidence. Have him review and work off a checklist he will likely give you. 
 

Just  jumó in on VAWA thread w questions ..ni need to make another post or worry about categories .
