Judge orders lesbian mother to give up daughters or find a male partner

MADRID – A judge has ordered a lesbian mother to hand over her two daughters to their father because, he said, her homosexuality would harm them and “raised the risk” that the girls would also become lesbians, press reports said on Monday.

Judge Fernando Ferrin Calamita, who heard the case at a court in the eastern region of Murcia, also said the woman could keep custody of the children if she found another male partner.

According to Ferrin, being raised by homosexual would not allow the children the right to the proper environment to which they were entitled.

“It is understood that (a parent’s) drug addiction, child abuse, prostitution, belonging to a satanic sect or heterosexual affair would negatively affect the children and serve as a reason for a change of custody,” he said. “Well, it’s the same with homosexuality.”

In his ruling, Ferrin criticized recent national laws against domestic violence and in favour of gay marriage, as well as legislation liberalising child custody. He claimed that the laws were “a mistake by the parliament controlled by the ruling party” in reference to the governing Socialists.

Women’s associations and gay rights groups protested the judge’s ruling and sent petitions to the Spanish judicial authorities claiming Ferrin had overstepped his authority.

That is ridiculous. Children need a loving and nurturing home environment. Whether or not their parents are gay shouldn't be a factor in a judge's decision. Being heterosexual does not automatically make you more competant as a parent.

Spain is still a very Catholic country so that's probably why the judge made that decision.

Doesn't spain have single-parent (typically mum-only + children) families? The judge could simply consider it as such--and bin the case (as it actually deserved).
