If you have truly exceptional circumstances, Montreal may accept your case for DCF.  But it seems to be so rare that the process is not quite smooth.  Here's an actual report of a DCF case (based on US job offer) accepted by Montreal in Dec 2022 -- https://www.visajourney.com/forums/topic/794959-dcf-from-canada-glitchy-process/

Thanks for the reply. Oh I gotcha, we ended up submitting the I-130 online with a bunch of proof and a letter stating our circumstances. Would the DCF not work now (if it was to get approved some how)? The I-130 I put in also says, "Case Is Being Actively Reviewed By USCIS" but I received an email this morning saying, "we have taken action on your case".

It's too late now for DCF, because you already have an I-130 petition pending with USCIS.  Should have waited for Montreal to accept or deny your request first, but oh well.  If they accept anyway, you'll have to let them know that you already filed an I-130 with USCIS and ask how to proceed.  They will likely rescind the DCF approval.

So Montreal reached out to me and asked for the following: 

  1. Please provide Petitioner’s address/residence  
  2. Please confirm that Petitioner is currently present in Canada  
  3. Has the Petitioner already filed a petition with USCIS?  
  4. Please provide an explanation of the exceptional circumstances (include scanned documentation to support the case, e.g. employment letter, deployment orders, medical documents, etc. ).   

 

  1. Petitioner’s Last Name:  
  2. Petitioner’s Maiden Name:  
  3. Petitioner’s First Name:  
  4. Petitioner’s Alias (Also known as):  
  5. Petitioner’s Middle Name:  
  6. Petitioner’s DOB, POB:  
  7. Applicant’s Last Name:  
  8. Applicant’s Maiden Name  
  9. Applicant’s First Name:  
  10. Applicant’s Middle Name:  
  11. Applicant’s DOB, POB:  
  12. Family relationship Petitioner-Applicant (child/spouse/parent 😞  

They also stated, "The applicant does not have to come to Montreal to submit the I-130 petition. Any U.S. Consulate in Canada will accept it. In fact, some consulates might be able to provide earlier appointments than Montreal. If the application is accepted by a consulate, they will forward it by mail to Montreal for further processing."

 

I emailed Montreal, Ottawa, and Toronto yesterday. Montreal hasn't responded yet, Ottawa didn't help at all, and Toronto asked if I can come in April for an interview. So that's awesome to hear! If I was to finish Packet 3 early, do you think they'd accept it? I know my wife would have to do two interviews, but we're trying to get ahead by already getting our police certificates and she has her medical scheduled for the end of this month.
