Hello

I am moving from the K-1 Visa thread to the AOS thread.  Looking for any help regarding filing the 485 and 765.  We got married last week and was ready to file the two forms when I started reading about also sending in I-693 at the same time.  Yes, no?  wanted to get the process started but 693 appointment is a month out

Thanks Keith

Why do you need to re do the Medical?

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Make sure you also do the I-131. Takes like 10 minutes to fill out, costs nothing, and (when granted) will allow you to actually leave the country if you are still waiting on your green card. There is no good reason not to file it, imo.

Do you have a copy of the DS-3025 from the K1 visa medical?  Does it say that the vaccination requirements have been completed?  If so, no need for I-693 when filing AOS from K1.  Just submit a copy of the DS-3025.

I don't ever recall seeing a DS-3025. Thanks for the info

Some visa medical clinics provide the applicant with their personal copy of DS-7794 instead.  Either DS-3025 or DS-7794 will do.  Both are vaccination worksheets.  The key point is that the worksheet must clearly indicate that the applicant has completed the vaccination requirements.

Found the DS-3025!!!  Another question, the instructions say to submit I-864 support affidavit,  obviously I filed one originally, do I need to send again with I-485

Thanks

If your spouse entered on a K1 visa, then you filed an I-134, not an I-864.  An I-864 is a legally binding contract, while an I-134 is not.  So yes, you must submit an I-864 with the I-485.

Part 3 asks if you ever applied for an immigrant visa for permanent residence status.  Does that include the current application or are they wanting to know any prior?

Prior immigrant visa applications.  Note that K1 is non-immigrant.  Unless your spouse has any prior applications other than the K1, the answer to the relevant question in Part 3 should be "No".
