I-864 (Part3 #29 and Part5 #8)

Hello I-864 experts,

I am using the current I-864 form (Edition Date: 12/08/21, Expires: 12/31/2023), and our household will just be my principal immigrant spouse and myself, which equals to 2.

Part3 #29 auto-fills to Part5 #1, which then auto-calculates to Part5 #8. So I input,

 

Part3 #29, 1 for my beneficiary spouse ("includes principal immigrant").

Part5 #1, auto-fills to 1 from Part3 #29.

Part5 #2, 1 for myself.

Part5 #3, 1 for spouse. 

Part5 #8, auto-calculates to 3 (NOT 2, but 2 is the total in my household).

 

Did I do this correctly?

The difference in the 1.25 X Poverty level guidelines for household of 3 (28,787.50=1.25*23,030) compared to 2 (22,887.50=1.25*18,310) is not a problem for me.

However, I'm afraid that I will get an RFE for not having the right household number, and can not fix this because of the auto-fill and auto-calculate function in the form I-864?

How have others with household of 2 input these items in the I-864?

Do NOT list your spouse except in #1.   

Read the form closely......Do not list any person more than once........items 2 thru 7 are only for people not sponsored.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

This field is not an autofill. Type 0. Problem solved. It will then auto calculate to  2 total.

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

Yes, this happens many times with this form, almost weekly we see this pop up. Good that you asked to be sure.

I'm glad you asked before you submit. When I was AOSing, I did not know this wonderful community, sent it out as 3 even though household size is 2, and bam! Got hit by the dreaded RFE.

Follow the advice provided by the members here and you'll be peachy.

FROM F1 TO AOS

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!
