I would say if you have all your court documents showing the disposition of your case then you can still DIY  USCIS will want to see any and ALL documents from the court pertaining to what they charged you with. They want to make sure the case is closed and you have paid your debt to society more or less (no pun intended). If you do not have them you'll need to get them because even if you do not do a K1 you will need the documents I spoke of on down the road several times I might add, so get them together now!!!

Ok yeah they gave me probation and made me pay court cost and restitution for the bad check amount. I paid all that and finished my probation with no violations i might add like 2 years ago. So basically I just go to the court I got In trouble with and get the papers proving that and that the case is closed and put that in the packet after I go back to Mexico to get married since I just went to get engaged and came back because of that lawyers information lol

@khahlh93 you got some great advice from @Sarge2155. Get your own court records. You don't need a lawyer for that.

Yeah definitely don’t need one for that. I’m sure I got to go to court house my self to get them any way.

So basically I just got to go back to Mexico , get married there, and then come back and do the packet for CR-1 spousal visa and all our proof. Then send packet in and wait?

That's right. Meantime, spend some time on the site, read about other people's experiences, look at processing times so you can set realistic expectations about the process. Good luck!

Thanks a lot to you and everyone that help on this post. You all made

me and me fiancé very happy and helped us dodge a bullet with that lawyer. Now I understand why she sounded so nervous when she said it had been a while since she done one of these types of cases. Should have saw that red flag better then. But yeah thanks a lot to you and everyone on this post. If any one has any other points feel free to send them my way.

I’m sorry, OP. I misread your post and thought your SO was the one with a misdemeanor. I know read it’s you, the USC, the one that has a misdemeanor. No, as long as you can get the court records pertaining to your case, you don’t need to hire a lawyer. I will say, though, that you have to disclose the incident if they ask about your criminal records on the forms (I can’t remember if they do or not, that’s why I say “if they ask you about your criminal records”).

I’m willing to bet money that the attorney you’re talking with is either not a real attorney, or is one of those attorneys that does a little bit of everything, like traffic accidents, immigration, family court etc. and why? Because any reputable immigration attorney would be at least updated and would never tell you that the K1s are faster or that your marriage is not valid here. That’s just bs. If you’re married in Mexico, you’re married whether it be Argentina, Mexico, USA or Kuala Lumpur. So don’t proceed with that attorney. You can DIY.

What I would do is to look at the guidelines for the spousal visa, read the instructions, and start thinking of getting married in Mexico. Come back and file tCR 1

Correct go to the court where you got in trouble at. Get several copies you'll need them later, make sure they are certified with a seal from the court. Go NOW get them ASAP, these forms are most important when dealing with USCIS and immigrations throughout your journey!

The lawyer wants 1500 for her work.

To be honest, $1500 sounds pretty cheap (almost too cheap) by most immigration attorney standards, which is a red flag by itself.

Yeah I made a typo that made you misread I think. But thanks great advice I’m so glad I didn’t pay her then fees and start the K-1 before I found this. I feel like this really saved us a lot of time and money

Yeah I definitely learned that lawyer was some bs from all of you guys thanks alot to all. I’m definitely going to go back and get married in Mexico then come back a file on my own. Since it’s me the USC with the misdemeanor and not her and I just need my court papers saying car is closed I will just do it all my self. And if I want to be lazy and not fill out forms my self maybe use boundless or something like that. But I’ll probably just do it my self because after dealing with this lawyer I don’t think I can trust any thing other my self and asking questions up here. It’s to many people Sauk g she wrong for it not to be true, especially when I remember her saying very nervously she had not done on of these cases in a while.

Well lucky for you she is in a country next door and you are able to visit now and then, it will make this long process easier.

Good luck.

I also have western union receipts of where I pay her rent food and Wi-Fi for us to talk like all day.

Paying for these things for a fiance can backfire actually.....common tactic by GC scammers....

Also lawyer told us when she came to America on K-1 visa if she lands in jfk that they give a stamp in your passport there that lets her work here with out that wait…

Incorrect.   Very outdated info.
