British Citizen/US Citizenship/Returning to UK

Hello, I couldn't really find a relevant forum so I'm hoping this might reach someone who has some insight. 

I am a UK Citizen currently on a 10 yr Green Card expiring in Sept 2022. I have applied for US Citizenship. Mostly because: 1: Our long term plans are to live in USA 2: My mother in UK is unwell and I may need to return and live there for more than a year to care for her and I don't want to have my Green Card rescinded or need to apply for exceptions after 1 year. So, the best course of action seems to be to gain Citizenship that way I can work and live in the UK as a UK citizen but then return to USA as a US citizen at a later time. I do understand there are tax implications to do that and I'll need to file when I am in UK. My question is, do I have any big blind spots or concerns with this course of action? Plus my wife is a US citizen and will need to work in the UK so any insight into wat the best plan/Visa type for her would be appreciated. Thank you, Tim

I know something about the UK process and the issue I see come up is meeting the sponsorship requirements.

This post might get some more attention if it is moved to the UK forum. I know a few USCs moved to the UK pre-pandemic so they might have good points for you... 

The last time I spoke to someone about sponsorship requirements for the UK it involved having a certain amount of money in a UK bank account for at least 6 months (if UK citizen did not have a job in the UK).

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

It's a shame you've left it to last year of your 10 year green card validity to consider applying for citizenship. I'm guessing you'll have to scramble to get your citizenship process complete before your greencard expires. You'll also have to complete that before you move to the UK.  

 

We went through the US to UK spousal visa process for my wife two years ago. Main obstacle you'll have is to show you have sufficient income and housing to accommodate your wife. Aside from that I would highly recommend getting a solicitor to help you with the process, the firm we used were amazing (Reiss Edwards, London), you can find my review of them on Google. The process is arduous but way faster, we got a response and my wife was in  UK in 4 months of applying. Path to permanent residency is harder for immigrants to the UK, it's spousal visa for 2.5 years then extend for further 2.5 years, then apply for indefinite leave to remain (permanent residence) and then immediately for naturalization and citizenship (if you choose to do so).

  • 20 Jan 2022: Passport with visa collected in person
  • 14 Feb 2022: Enter USA via Dulles, airport

With my 93 yr old parents still living in Australia, I understand your reasoning for naturalizing. I did it for the exact same reasons .. processing time is dependent on your service centre .. mine was Kansas City .. and thankfully my application to oath was only 8 months. I avoided the expired GC issue by applying as soon as I was eligible .. but we don't usually get to see whats facing us next year so .. do what you need to to renew the GC if needed.. it will be worth it   I can come and go now without counting days, answering incoming CBP questions, worrying about losing or replacing  my GC.. and I still get to pay taxes !! 🤪
