Timeline

I filed an I824 but it was sent back to me claiming I didn't sign it when I did. I hired a lawyer to finish the rest of my case since I already made so many mistakes and am now paying for it by being separated from my husband longer. It's been two weeks and I haven't heard anything from my lawyer. So I was wondering if anyone knew how to file an I824 in case I need to file it myself if I have hired a dud laywer. All I need is my approved I130 transferred to NVC and I don't understand why this is so hard or what I'm not understanding for filling out this small form and am currently in tears 😭

Just checking do you mean I-824 or I-864? It’s two different forms…

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

If they didn’t say anything else is wrong, then fill it out the same way you did and sign it and send it. It’s a pretty straightforward form. Just a word of advice: you should scan everything you send to and receive from immigration. If you had scanned this form before sending it you would know for sure if you signed it correctly or not.

OP indicated both AOS and consular processing on the form so USCIS thinks the spouse is in the US.

your Noa2 was just in December 2021 

have u paid the 2 fees to be able to do the I 864 and ds 260

 

December  is so current /  many in your shoes are waiting at NVC a year and your timeline doesn't even show u paid the fees to get things started at NVC 

filling a I 824 to make things move faster won't work 

there's a lot to do at NVC stage to even get in queue for a interview

They’re not doing it to speed it up. They made a mistake on their I-130 and USCIS thinks the spouse is in then US and adjusting status

i saw your post after sending mine

i hope the lawyer can correct this issue

at least now you have let the OP know of her mistake and that the I 824 is useless

Filing the I-824 is time consuming and can delay the process.

Wouldn’t it be faster to close the case and start from scratch, now that OP knows what the mistakes were?

what office has the case if USCIS thinks its AOS?

NVC wouldn't get it

she is not AOS  in the US

 

I think you need to read the previous post because you’re confusing things…. They’re trying to get USCIS to send the petition to NVC so it can be processed there and sent to the consulate eventually when they’re DQ’d. They indicated by mistake that he’s doing AOS so USCIS did not send the case to NVC

yeah,  instead of paying steep fees to a lawyer ,  it would have been cheaper to do a new petition

That was also my thought. But in OP’s previous thread and another similar thread (link below) they were advised to wait out the I-824.
